The Council finds that during certain times of the year fire hazards exist due to the presence of flammable material and cover. Because of the existence of hazardous fire areas, the unsupervised burning of rubbish, rags, papers, weeds, grass, refuse and other combustible material within the Town constitutes a fire and safety menace to the citizens of the Town.

The "Fire Control Authority" referred to in this chapter means any person or organization to which the Council has delegated the duty to control fires in the Town.

It is unlawful for any person to set fire or cause fire to be set out-of-doors (except for barbecues and food smokers as permitted in Section 8.16.040) at any time between May 1st and the close of fire season, as established by the State Department of Forestry and Fire Protection, of any year without first obtaining a fire permit from the Fire Control Authority.

No person may set a fire out-of-doors between May 1st and the close of fire season, as established by the State Department of Forestry and Fire Protection, of each year between the hours of 4:00 p.m. and 8:00 a.m. of the next following day, except that barbecues and food smokers shall be permitted provided they are managed so as to ensure that the fire will not spread to adjacent lands or material.

The requirements prescribed in Section 8.16.040 do not apply to the use of fire for land-clearing operations in accordance with a special permit for this purpose issued under Division 4, Chapter 7, Sections 4475 through 4494 of the Public Resources Code. In addition, when special conditions exist, as determined by the Fire Control Authority, the Fire Control Authority may specify in the written permit that burning may take place during the hours from 4:00 p.m. to 8:00 a.m. of the next following day.

At any time that climatic conditions are such, in the opinion of the Fire Control Authority, as to create a situation that makes the use of fire hazardous, the Fire Control Authority may suspend all out-of-door burning.

A violation of the terms of the burning permit issued under this chapter is prima facie evidence of noncompliance with the terms of the permit and makes the permit void.

A. 
There is established around the scene of every nonpermitted fire during its course a fire zone consisting of all public streets within a radius of 500 feet of the fire. All vehicle and pedestrian traffic within a fire zone shall stop.
B. 
It is unlawful for a person to move or operate a vehicle within the fire zone except upon the order of the Fire Control Authority.
C. 
No person may enter a fire zone or stop, stand or park within a fire zone in such manner as to hinder the apparatus of the Fire Control Authority.

If a fire originates from the operation or use of an engine, machine, barbecue, incinerator, railroad rolling stock, chimney or any other device which is capable of kindling a fire, the occurrence of the fire is prima facie evidence of negligence in the maintenance, operation or use of the device. Any fire that escapes from the place where it originates and it can be determined which person's negligence caused such fire, that person is guilty of a misdemeanor.
