A. 
This chapter is adopted pursuant to, and is intended to be consistent with, the State Fireworks Law (Health and Safety Code Sections 12500 and following).
B. 
The meaning and definition of all terms used in this chapter shall be the same as such terms are defined and used in the State Fireworks Law.

Public displays of fireworks may be permitted within the Town limits if conducted by a person appropriately licensed under the State Fireworks Law, upon obtaining from the Town a permit applied for and granted in accordance with the provisions of Health and Safety Code Sections 12640 and following, provided, however:
A. 
The application for a permit shall be made at least 45 days prior to the proposed display.
B. 
The Council shall grant a permit only upon finding that the public benefit outweighs the public detriment and that the applicant has complied with the provisions of the State Fireworks Law.
C. 
The Council may grant a permit subject to reasonable conditions.
