No person under the age of 18 years may be in, on or about a public street or other public place or any place open to the public in the Town between 10:00 p.m. and sunrise of the following day, unless accompanied by a parent, guardian or other adult person having the care, custody or control of such person. This section shall not apply when the person is returning directly home from a meeting, entertainment, recreational activity or dance; when the person is going directly to or returning from work; when the person is upon an errand or emergency directed by his or her parent or guardian or other adult person having the care, custody or control of such person; or when the person is exercising rights protected by the State or Federal constitutions.

Every parent, guardian or other person having the care, custody or control of a person under the age of 18 years who permits that person to violate Section 9.08.010 is guilty of a misdemeanor.

A person under the age of 18 years of age who violates Section 9.08.010 may be detained until the arrival of a parent, guardian or other proper person having custody or control.

Every parent, guardian or other person having a minor in his or her charge who fails or neglects to go in person or send some suitable person to where the minor is detained, after receiving notice that the minor is detained, is guilty of a misdemeanor.

A person under the age of 18 years who violates the provisions of Section 9.08.010 shall be guilty of a misdemeanor and shall be dealt with in accordance with juvenile court law and procedure.
