No person shall drink any malt, spirits, wine or other liquor containing more than one-half percent of alcohol by volume, or hold or exercise domain and control of any uncapped or open container containing such beverages:
A. 
Upon any street, sidewalk, highway, alley, public park, public parking lot, or public trail;
B. 
Upon any public school ground, bleacher, or stadium; or
C. 
Upon any private street, building or other private property within the Town without the consent of the owner, the owner's agent, or the person in lawful possession of the property.

Notwithstanding Section 9.24.010, it shall not be unlawful for any person to drink or possess any open containers of an alcoholic beverage as defined in such section:
A. 
Within the designated area of any public street, sidewalk, lane or alley, or in or upon any place open to the patronage of the public if such person has purchased the beverage from premises which are selling it as part of an event that has received a permit pursuant to Chapter 8.24.
B. 
In a public park as allowed pursuant to Chapter 12.12.
