In this title, unless the context otherwise requires, the following definitions shall apply:
"Agency"
means the processing agency as defined below.
"Coach"
means a motor bus, motor coach, trackless trolley or passenger stage used as a common carrier of passengers.
"Contestant"
means any operator or registered owner as defined in this section who contests a parking citation.
"Curb"
means the lateral boundary of a roadway or parking lot whether marked by curbing construction or not.
"Department"
means the Department of Motor Vehicles.
"Divisional island"
means a raised island located in the roadway and separating opposing or conflicting streams of traffic.
"Hearing examiner"
means any individual selected by the Town, or if the Town elects to contract for parking citation processing services, that individual selected by the processing agency authorized to administratively adjudicate parking citation contests.
"Holiday"
means: (1) Saturday and Sunday; (2) January 1; (3) Martin Luther King Jr. Day; (4) President's Day; (5) Memorial Day; (6) July 4th; (7) Labor Day; (8) Admission's Day; (9) Columbus Day; (10) Veteran's Day; (11) Thanksgiving Day and the day following; and (12) Christmas Day. For enforcement purposes, the holiday shall be the day so stated, or the Friday before or Monday following if that is the day designated as the observance day for the indicated holiday.
"Issuing agency"
means the Town or its authorized agent that issues parking citations.
"Issuing officer"
means a peace officer as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of the Penal Code or other issuing person who is authorized to issue a parking citation.
"Loading zone"
means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
"Official traffic control device"
means any sign, signal, marking or device, placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic, but does not include islands, curbs, traffic barriers, or other roadway design features.
"Official traffic control signal"
means any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and proceed and which is erected by authority of a public body or official having jurisdiction.
"Operator"
means any individual driving and/or in possession of a vehicle at the time a citation is issued, or the registered owner.
"Parking citation"
means a notice that is personally given or mailed to the operator, or attached to the operator's vehicle. Informing the operator of a parking, equipment and/or other vehicle violation and the operator's right to elect to pay the fine for the violation or contest the citation.
"Parking penalty"
includes, but is not limited to, the parking penalty for the particular violation, as well as late payment penalties, administrative fees, assessments, costs of collection as provided by law, and other related fees.
"Parkway"
means that portion of a street other than a roadway or a sidewalk.
"Passenger bus"
means any motor vehicle designed for carrying more than 10 passengers and engaged in the transportation of persons for compensation, as defined in Division 1, Section 233 of the Vehicle Code.
"Passenger loading zone"
means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
"Pedestrian"
means any person afoot, in a motorized wheelchair, or who is using a means of conveyance propelled by human power other than a bicycle.
"Police officer"
means and includes every officer of the Police Department of the Town or officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
"Processing agency"
means the Town or its authorized agent that processes parking citations and issues notices of delinquent parking violations on behalf of the Town.
"Recreational vehicle"
is any motor home, travel trailer, or camping trailer designed for human occupancy.
"Registered owner"
means the individual or entity whose name is recorded with the Department of Motor Vehicles as having ownership of a particular vehicle.
"Stop or stopping"
when prohibited means any cessation of movement of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control device or signal.
"Vehicle"
means any self-propelled vehicle operated or suitable for operation on a highway.
"Vehicle Code"
means the Vehicle Code of the State.
"Violation"
means any parking, equipment, or other vehicle violation established pursuant to ordinance or State law.
