All members of the Police Department are hereby authorized and empowered, under the direction and control of the City Manager, to regulate, direct and restrict the parking of vehicles of any character on any public street, avenue or alley within the City.

Angle.
Where angle parking is required, vehicles shall stand at an angle of about forty-five degrees (45°) to the curb and with the right front wheel touching or within one foot of the curb and shall not be parked nearer to each other than one foot.
Parallel.
Where parallel parking is required by the provisions of this Article, vehicles shall stand or be parked parallel with and within 12 inches of the curb, and shall not be parked nearer to each other than three feet.

Except when actually engaged in loading or unloading commodities, all vehicles shall be parked at an angle with the curb on:
A. 
First Street from 1st Ave West to 2nd Ave East; and
B. 
On 2nd Ave East from 1st Street East to 3rd Street East.
All other parking within the City limits shall be parallel with the curb.

Except as otherwise provided in this section, it is unlawful for any person to stop, stand or park or permit to be parked any vehicles of any character on or in any of the following areas within the City:
A. 
On Center Street as follows:
1. 
On the north side between Main Street and Fourth Avenue East, at any time;
2. 
On the south side between Main Street and Fourth Avenue East, at any time;
3. 
On the north side between Main Street and Fifth Avenue West, at any time;
4. 
On the south side between Main Street and Fifth Avenue West, at any time.
B. 
South side of First Street East between Main and Third Avenues East, at any time.
C. 
On Second Street as follows:
1. 
On the south side between Fifth Avenue East and Woodland Avenue, at any time;
2. 
On the south side, within 60 feet (on either side) of the crosswalk, at the intersection of Second Street East and Fourth Avenue East.
D. 
On Fifth Avenue West as follows:
1. 
On both the east and west sides of Fifth Avenue West between the Burlington Northern Railroad tracks and Eleventh Street West, at any time, except south end of east side of 000 Block;
2. 
On both the east and west sides of Fifth Avenue West north between West Washington Street and West Idaho Street, at any time.
E. 
On any street within the City, at any time, within 30 feet upon the approach to any flashing beacon, stop sign or traffic-control signal located at the side of the roadway of such street.
F. 
Within 20 feet of a crosswalk, at any time, on the following streets:
1. 
Main Street from the south City limits to its intersection with Sunset Boulevard (U.S. 93);
2. 
Sunset Boulevard (U.S. 93) within the City limits;
3. 
Idaho Street (U.S. 2) within the City limits;
4. 
Within 20 feet of the crosswalk of any street intersecting any of the aforementioned streets at its intersection with any of the aforementioned streets.
G. 
At any time on the roadway side of any vehicle stopped or parked at the edge of or curb of Main Street from the south City limits to its intersection with Sunset Boulevard (U.S. 93); Sunset Boulevard (U.S. 93) within the City limits; Idaho Street (U.S. 2) within the City limits.
H. 
On Eighth Street as follows:
1. 
On the south side between Fourth Avenue East and Fifth Avenue East, at any time;
2. 
On the north side between Fourth Alley West and Fifth Avenue West, at any time;
3. 
Within 80 feet of each leg of the intersection of Fifth Avenue East and Eighth Street East.
I. 
On the east side of Meridian Road between Idaho Street and Three Mile Drive, at any time.
J. 
On either side of Main Street/Sunset Boulevard between Idaho Street and Arizona Street, at any time.
K. 
On the north side of Eleventh Street between Fourth Avenue West and Fifth Avenue West, at any time.
L. 
On the south side of Fourth Street West between Second Avenue West and Fifth Avenue West, at any time.
M. 
On Sixth Street as follows:

On the south side between Main Street and First Avenue West, at any time;

On the south side between the southerly offset of Fourth Avenue West and Fifth Avenue West on school days between the hours of 8:00 a.m. and 4:00 p.m.; provided, however, school bus parking shall be permitted thereon to discharge and load students at all times.

Within 80 feet of each leg of the intersection of Fourth Avenue East and Eighth Street East;

On the south side of Fourth Street East between Second Avenue East and Woodland Avenue, at any time.
P. 
On the west side of Main Street between Ninth and Tenth Streets, at any time.

On Second Street East, on the south side between Second Avenue East and Third Alley East, at any time.
R. 
On Third Street East, on the north side between Second Avenue East and Third Alley East, at any time.
S. 
On Third Street East:

No motor vehicle shall be parked continuously at any one place for more than 30 minutes between the hours of 8:00 a.m. and 6:00 p.m. at the following locations:

In the first parking stall adjacent to and on either side of First Avenue East on the:
a. 
North curb line of Second Street East,
b. 
South curb line of Third Street East,
c. 
North curb line of Fourth Street East;
2. 
In the first parking stall adjacent to and on either side of First Avenue West on the:
a. 
South curb line of First Street West, on west side only,
b. 
North curb line of Third Street West,
c. 
North curb line of Fourth Street West, on east side only,
d. 
South curb line of Fourth Street West, on west side only;
3. 
The southernmost three parking spaces on the southbound west side of First Avenue West between Second Street West and Third Street West;
4. 
On the north side of Third Street East, in the first two parking stalls west of First Alley East.
V. 
On Oregon Street as follows:
1. 
On the north side of Oregon Street from its intersection with Main Street for a distance of 50 feet east of the curb line of Main Street, at any time;
2. 
On the south side of Oregon Street East from its intersection with Main Street to First Alley East.
W. 
On Ninth Street East, on the north side of Ninth Street East between Fourth Avenue East and Fifth Avenue East.
X. 
Heritage Way. Vehicular parking is prohibited on either side of the street on Heritage Way beginning at the intersection of Heritage Way and Sunnyview Lane and continuing 480 feet along Heritage Way.
Y. 
Fourth Avenue West and Twelfth Street West. Vehicular parking is prohibited on the east side of Fourth Avenue West from Eleventh Street West to the southern terminus of Fourth Avenue West and on the north side of Twelfth Street West for a distance of one-half block from Fourth Avenue West to the next alley entrance to the east.
Z. 
Bus Loading Zones. Vehicular parking, other than for public transportation buses, is prohibited in any parking space designated by signage for Bus Loading Only between the hours of 6:00 a.m. and 6:00 p.m. Monday through Friday.

A. 
City Owned Parking Lots: The Kalispell Police Department is given the authority to manage and supervise all parking of motor vehicles in City owned parking lots. It shall have the duty to adequately and appropriately sign all lots with clearly visible information to all users of the parking lot regarding hours of operation, time limits and fines for violating the terms of use. The Kalispell Police Department shall further have the duty to enforce the parking regulations of the parking lots. Violations shall be deemed civil infractions subject to the terms of KMC 1-12.
B. 
Privately Owned Parking Lots with Public Parking Provisions: The Kalispell Police Department, on behalf of the City, is given the authority to enter into leases or user agreements with owners of private parking lots in which public parking, by agreement with the property owner, is provided. It shall then have the authority to manage and supervise the parking of motor vehicles within those private parking lots to the extent of the agreement with the private owner. It shall have the duty to adequately and appropriately sign such private lots with clearly visible information to all users of the parking lot regarding hours of operation, time limits and fines for violating the terms of use. The Kalispell Police Department shall further have the duty to enforce the parking regulations of these private parking lots. Violations shall be deemed civil infractions subject to the terms of KMC 1-12.

A. 
It is unlawful to park any vehicle on any street for any purpose whatsoever so that any part of such vehicle or its load extends into the street to a point nearer than eight feet from the centerline thereof.
B. 
The object of this provision is to keep an open space or clearance of 16 feet in the middle of the highway at all times, and if a vehicle or its load is of such length that it cannot be parked on a certain highway so as to conform with this and other provisions of this chapter, it shall not be left standing upon such highway.

No person having charge of a vehicle ordinarily drawn by horses shall allow such vehicle to remain in any public highway, unless such vehicle has horses attached thereto, nor shall any person having charge of a trailer allow such trailer to remain on any public highway unless attached to a vehicle by which it may be propelled or drawn; provided that in the case of accident, such vehicle may be moved to the side of the highway and if a good and sufficient red light signal be displayed at both ends thereof during the hours of darkness, may remain upon the highway for a period of not exceeding 24 hours, pending removal for repairs, except that such vehicle shall not remain upon any of the highways where standing or parking is limited, for a longer time than is necessary to effect its removal.
This provision shall not apply to the parking of authorized law enforcement vehicles, left unattached along any public highway in the City as part of a law enforcement activity.

A. 
In leaving a parallel parking space, vehicles must in all cases head out into the line of traffic and shall not in any case back out of such parking space.
B. 
The operator of a motor vehicle on leaving a parking space shall exercise great care to avoid an accident when entering into the line of traffic.

No vehicle shall be left parked, except while actually being loaded or unloaded or while taking on and discharging passengers, upon any street along the curb thereof in front of any motion picture show, theater or other amusement house or any hotel entrance. By front is meant the distance between the two side lines of the building or portion of building used for a motion picture show, theater or other amusement house; provided, that the restriction contained in this section shall apply to only one entrance to any one hotel, as selected by the proprietor thereof, and that the restricted area in front of such hotel entrance shall include a distance of 30 feet only along the curb.

No vehicles shall be parked or left standing within 15 feet of a fire hydrant. Such distance is to be measured back from the hydrant and along the curb.

No vehicle shall double park on any street except when calling for or delivering merchandise or taking on or discharging passengers, and when access to curb parking is blocked by other vehicles, at the place of delivery and then, only for such length of time as may be necessary to load or unload.

Where parallel parking is required, no vehicle shall be parked within three feet (3') of the property line at any public highway intersection. Such distance is to be measured back from the property line and along the curb line.

Where angle parking is required, no vehicle shall be parked within ten feet (10') of the property line at any public highway intersection. Such distance is to be measured back from the property line and along the curb line.

No vehicle shall stand backed to the curb except when actually loading or unloading some commodity, and if the vehicle is horse-drawn, the horse shall stand parallel to the curb and face in the direction of traffic.

It shall be unlawful for any person to stop, stand or park a vehicle within twenty feet (20') of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five feet (75') of the entrance when properly signposted.
Except on one-way streets, it shall be unlawful to stand a vehicle in such a manner as to bring the left side thereof next to the curb, or to stand a vehicle at a greater distance than one foot from the curb.

Vehicles, other than commercial, shall not park in any alley. Commercial vehicles shall not park in alleys longer than is required to load or unload when so parked. Such vehicles shall stand as close as possible to one side of the alley and in any case shall so stand as to permit other vehicles to pass. Vehicles in alleys shall comply with the directions and order of police officers.

Vehicles engaged in loading or unloading passengers or commodities, while on the public highway, shall be loaded and unloaded continuously and as rapidly as practicable.

A. 
Established: The Chief of Police, with the consent of the City Council, may establish loading zones on any of the streets or in any public park of the City. Such zones shall be for temporary parking while loading or unloading of persons, merchandise or commodities and may be used only for such purpose; the location and boundary of same shall be clearly marked with appropriate signs or by markings on the street surface or curb adjacent thereto.
B. 
Conditions, Limitations Determined: Conditions and limitations of use of a loading zone as to duration, times of day and purpose shall be determined when same is established; any such conditions or limitations shall be included in the signing or marking of the space set aside as a loading zone. It is unlawful to use an established loading zone except in accord with the conditions and limitations of its establishment and signs or marking.
C. 
Use: A loading zone established in accord herewith, may be used by any person, subject only to the conditions and limitations as have been imposed in accord with subsection B of this section.
D. 
Registered Owner Violator: In any prosecution charging a violation of this section, proof of the identity of the registered owner of the vehicle found in violation thereof shall create a prima facie presumption that such registered owner was the person who parked such vehicle at the time and place where the violation occurred.

No truck or other motor vehicle having a wheel base of greater than a one hundred thirty-three inch (133ʺ) chassis or a bed of greater length than eight feet (8') shall be parked on any street or avenue at an angle to or diagonal to the curb or in any other manner than parallel to and adjacent to the curb of such street or avenue.

A. 
It shall be unlawful to lodge within a motor vehicle in the public right-of-way in the City of Kalispell.
B. 
Definitions:
Lodge.
To board and use as a living quarters.
Motor vehicle.
An automobile, truck, recreational vehicle, camper or bus.
C. 
This section shall be enforced by the City of Kalispell Police Department. A violation of this section shall be a civil infraction and provided the due process as set forth in Chapter 1, Article 2 of the Kalispell Municipal Code.

A. 
Schedule: Between the hours of 2:00 a.m. and 8:00 a.m. at all places in the City equipped with parking meters, there shall be no parking of motor vehicles except in accordance with the following schedule:

B. 
Streets Defined: For the purposes of this section, "streets" mean all streets running easterly and westerly; "avenues" mean all streets running northerly and southerly.
C. 
Directions Printed on Meter: The Chief of Police shall cause to be affixed to each parking meter printed directions specifying when parking is allowed in accordance with the foregoing schedule.

The snow season is considered to be the period from November 1st through March 31st. During the snow season parking shall not be permitted in City-owned off-street parking areas between the hours of 2:00 a.m. to 6:00 a.m. In the central business district, the on street parking prohibition shall be between two 2:00 a.m. to 6:00 a.m. Parking in other areas of the City of Kalispell shall be as recommended in the most current revision of the City of Kalispell policy and procedure manual for snow and ice removal.

It shall be unlawful for any person to store or leave upon the streets any motor vehicle for indefinite periods of time; it is the intent hereof that no motor vehicle shall be parked or left on such streets unless it is in constant use. Any motor vehicle not used at least once every 72 hours shall be deemed to be stored in violation hereof. Any person leaving upon any street any motor vehicle not in running condition or that is not properly registered in the State of Montana pursuant to the terms of Montana State Law shall be deemed prima facie guilty of a violation hereof, which may be rebutted only by showing that such motor vehicle had just broken down and such person had not yet had time to remove it from the street or that the registration was invalid for less than 30 days. The owner of such a vehicle shall be responsible for a violation hereof as well as the person so leaving it.

All parking violations, except handicapped parking violations, occurring in the City of Kalispell, are declared to be civil infractions, and shall be processed in accordance with the municipal infractions under Sections 1-11 through 1-18 of this Code as authorized by Montana Code Annotated Sections 7-1-4150 through 7-1-4152, or as subsequently amended.
A. 
Civil citations for parking violations enumerated in this section may be issued by an authorized official of the Kalispell Police Department.
B. 
A civil citation issued under this section may be served either by personal service, or by certified mail addressed to the defendant at the defendant's last known address, or by publication as provided in rule 4D(5) of the Montana Rules of Civil Procedure. The citation must serve as notification that a municipal infraction has been committed and must contain the following information:
1. 
The name and address of the violator (i.e., the defendant);
2. 
The name or description of the infraction attested to by the officer issuing the citation;
3. 
The location and time of the infraction;
4. 
The amount of civil penalty to be assessed or the alternate relief sought, or both;
5. 
The manner, location, and time in which the penalty may be paid;
6. 
The time and place of court appearance; and
7. 
The penalty for failure to appear in court.
C. 
Municipal infraction proceedings shall be conducted in accordance with procedures set forth for such infractions under State law.
D. 
The civil penalties for proved violations of the municipal infractions set forth in this section shall not exceed $300 for each violation, or if the infraction is a repeat offense, a civil penalty not to exceed $500 for each repeat violation.

A. 
Any motor vehicle parked or left in violation of this article or any other provision of this chapter or other ordinance of the City regulating the stopping, standing or parking of vehicles may be incapacitated with a wheel boot under the direction of the Kalispell Police Department or moved by or under the authority of any police officer who shall certify the cost thereof to the Municipal Judge. Such cost of incapacitation or removal may be added to any fine assessed for the violation involved; the owner or operator of such vehicle shall pay all costs of moving and storage of such vehicle.
B. 
Such motor vehicle may be moved to any parking lot provided by the police or to a local garage for outdoor storage.
C. 
If any vehicle is found to have been stopping, standing or parking in violation of any ordinance of the City or law of the State over which the City court has jurisdiction, the registered owner thereof shall be prima facie responsible for such violation and subject to the penalty thereof.

Whenever the space occupied by a parked motor vehicle is necessary for loading or unloading some commodity, the owner or operator of such vehicle shall move away from such space upon the request of a police officer. However, such vehicle may not be moved by or under the direction of such police officer unless such vehicle is then parked in violation of this chapter or some other ordinance of the City.

A. 
Permit: The City may grant to any person, K-12 school, agency or business a permit for the permanent use of a reserved parking space on a public street or City-owned or -operated off-street parking lot for use of a taxicab, bus, delivery vehicle or similar commercial vehicle or device used for the transportation of persons or property. The City may grant any K-12 school a permit for loading areas and/or short-term parking.
B. 
Application: A person desiring such a permit shall make a complete application therefor to the City Public Works Department, setting out the name and address of the applicant, the business or other purpose for which the parking space will be utilized, the number and location of the parking spaces desired, certified list of property owners within 150 feet, and any other information deemed pertinent to the application. A permit will be granted only if it serves a public purpose.
C. 
The Public Works Administrator shall:
1. 
Accept the Completed Application:
a. 
Mail written notice to all property owners within 150 feet of the subject location providing at least 15 days for formal comment (where the subject property abuts a public right-of-way, the 150 foot measurement shall be in addition to the right-of-way along the abutting side);
b. 
Review the application pursuant to the review criteria contained in the permit requirements; and
c. 
The applicant shall be responsible for paying a fee for the cost to mail the public notices, if public notices is applicable, as part of the permit process.
2. 
If no public comment is received, the Permit Administrator shall approve, conditionally approve, or deny the application as appropriate.
3. 
If public comment is received, the Permit Administrator shall contact the applicant.
a. 
If the comment can be satisfactorily resolved by additional information or appropriate conditions, the Permit Administrator shall approve, conditionally approve, or deny the application as appropriate.
b. 
If the comment is of substance and cannot be mitigated, the Permit Administrator shall approve, conditionally approve, or deny the application as appropriate.
4. 
If the applicant wishes to appeal the Permit Administrator's decision regarding the application, the application shall be forwarded to the Public Works Director for consideration. If the comment is of substance and cannot be mitigated, the Public Works Director's recommendation shall be forwarded to the City Council for a determination as to whether the permit should be approved, conditionally approved, or denied. Any appeal by the applicant must be submitted in writing to the Public Works within 30 days from the date the permit was issued or denied.
D. 
Grant of Permit; Revocation: If the Public Works Permit Administrator finds that a public benefit will be served thereby, it may grant such a permit, designating the parking spaces to which applicable and such other conditions as may be deemed reasonable to the use thereof. Unless stated otherwise in the grant of the permit, same shall be permanent until revoked by the City. The City may revoke any such permit at any time upon 30 days' written notice to the permittee. A permittee may surrender and terminate a permit at any time by written notice thereof to the Public Works Permit Administrator.
E. 
Parking Space Defined: For the purpose of this section, "parking space" is defined to be a space or stall of 22 feet in length, measured along the curb line of the street or avenue where parallel parking is used or permitted, and a space or stall of twelve and one-half (12 1/2) feet in length measured along the curb line of the street or avenue where 45 degree angle or other angle parking is used or permitted.
F. 
Installation of Signs: The street superintendent shall install in parking spaces covered by any permit granted hereunder, appropriate and uniform signs clearly designating the existence and boundary of the area covered thereby and the identity of the permittee. The permittee shall reimburse the City for the actual expenses incurred in the installation of the signs, etc.; all such signs, etc., shall be removed by the City promptly whenever any permit is revoked or terminated.
G. 
Use by Permittee: Any parking space covered by a permit granted hereunder may be used by the permittee, his or her employees or agents only; any other person using such parking space at any time shall be guilty of a misdemeanor. The provisions of Section 17-79 of this article apply to all violations of this section. The vehicles of a permittee, his or her employees or agents shall be clearly identifiable as such while using any parking space covered by such permit.

It is unlawful for a person to wilfully park a motor vehicle in a parking space designed as reserved for handicapped persons unless such motor vehicle bears or contains a valid clearly visible card, plate, certificate or insignia issued to handicapped persons by the Division of Motor Vehicles, Department of Justice, of this State, in accord with Montana Code Annotated Section 49-4-301 et seq. Such card, plate, certificate or insignia shall be prominently displayed on the windshield of a vehicle when the parking privilege is being used.

A. 
Registered Owner Violator: In any prosecution charging a violation of Sections 17-82-1 through 17-82-3 of this article, proof of the identity of the registered owner of the particular vehicle parked in violation thereof shall create a prima facie presumption that such registered owner was the person who parked such vehicle at the point where the violation occurred.
B. 
Penalty: A violation of this section shall constitute a misdemeanor. Vehicles found parked in a designated handicapped person parking space in violation of this section may be removed and impounded, at the direction of the Chief of Police and the cost of such removal and impoundment must be paid before the vehicle need be released to the registered owner.
C. 
Fine: Any person convicted of violation of Sections 17-82-1 through 17-82-3 of this article shall be punished by a fine of not less than $10, nor more than the maximum fine permitted by Section 1-9 of this Code.

A. 
The ordinances codified in this section establish an on-street permit-only parking zone to be known as the Westside Neighborhood Parking Management Zone as set forth below.
1. 
The permit resident only parking restrictions shall be limited to:
a. 
2nd Avenue West, between 6th and 9th St. West;
b. 
3rd Avenue West between 5th and 9th St. West;
c. 
4th Avenue West between 8th and 9th St. West;
d. 
6th Avenue West between 7th and 8th St. West;
e. 
5th Street West between 5th Avenue West and 6th Avenue West;
f. 
4th Avenue West between 5th Street West and 6th Street West; and
g. 
All streets between 4th Avenue and 2nd Avenue West.
B. 
The cost of administration of the resident only parking restrictions shall be borne by the users, based on a fee per permit as established by resolution by the City Council.
C. 
The City shall be responsible for the placement and maintenance of required signage notifying the public of the existence of parking restrictions.
D. 
The permit parking restrictions shall be in effect from 8:00 a.m. to 3:00 p.m. from Monday to Friday, on days when school is in session.
E. 
The School District may request from the City a "special events exclusion" to accommodate several high volume events that occur throughout the year at Flathead High School. In this case the neighbors/property owners would be notified by the school in advance and the parking restrictions would be suspended for that day.
F. 
Parking permits shall be clearly displayed in the front window of the vehicle. If no permit or an improper permit is displayed a parking citation shall be issued by the Kalispell Police Department.
G. 
Contractors engaged in providing service to a resident in the zone shall be exempt from the permit resident only parking restrictions.
H. 
General Provisions for Resident On-Street Parking:
1. 
Each resident in the Zone is entitled to two free parking permits.
2. 
Proof of residency and/or property ownership is required to obtain an on-street resident-only parking permit.
3. 
Proof of vehicle ownership and current registration is required for each on-street resident-only parking permit.
4. 
A resident or owner may purchase one or more guest passes separate from a registered vehicle permit. There is no limit to the number of guest passes that a resident or owner may purchase.
I. 
General Provisions for Student-Teacher District 5 Employee On-Street Parking:
1. 
Student-teacher-District 5 employee permits may be purchased each year from the City for parking within the Zone.
2. 
A permit allows on-street parking; it does not ensure a parking space.
3. 
Student-teacher-employee parking shall be limited to one side of each street or avenue within the Zone as signed.
4. 
The specific side of the street or avenue shall change yearly on January 1st as signed.
J. 
The Parking Management Zone Boundaries May be Amended:
1. 
The City, in its discretion as the governing body, may amend or reduce the Westside Neighborhood Parking Management Zone boundaries after holding a hearing before the Kalispell City Planning Board.
2. 
Requests to be added to or removed from resident-only parking restrictions shall be done at the block face level meaning both sides of a facing avenue or street.
3. 
A petition signed by 75% of the property owners of the facing avenue or street face within the Westside Parking Management Zone shall be presented to the City on a form approved by the City of Kalispell.
