Words and phrases defined in Chapter 8.16 of this code shall have the same meaning when used in this chapter.

It is unlawful for any person to gather, collect or remove any discarded materials from any place except only as to the following:
A.
The city, its agents, servants and employees while acting as such;
B.
A contract agent of the city and its agents, servants or employees acting pursuant to the terms and conditions of a contract with the city;
C.
Persons holding a franchise from the city to the extent allowed by their franchise;
D.
Persons engaging in the business of gardening or landscaping as an incident to such business.
