The following words and phrases, whenever used in this chapter, shall be construed as defined in this section:
"Parade"
includes any parade, march, ceremony, show, exhibition, pageant or procession of any kind, or any similar display, in or upon any street, park or other public place.

No person shall engage in, participate in, aid, form or start any parade, unless a permit to do so has been obtained from the chief of police, and unless such permit is carried by the person heading or leading such activity; provided, however, that the provisions hereof shall not apply to funeral processions, nor to students of the schools going to and from classes or when constituting a part of their educational activities and under the immediate direction and supervision of the proper school authorities, nor to any governmental agency within the scope of its functions.

Applications for a parade permit shall be filed with the chief of police not less than thirty days nor more than ninety days before the date on which it is proposed to conduct the parade. Such applications shall be sworn to and shall state:
A. 
The name of the person or organization wishing to conduct such parade;
B. 
If the parade is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible head of such organization;
C. 
The name, address and telephone number of the person who will be the parade chairperson and who will be responsible for its conduct;
D. 
The name, address and telephone number of the person or organization to whom the permit is desired to be issued;
E. 
The date when such parade is to be conducted;
F. 
The route to be traveled, the starting point and the termination point;
G. 
The approximate number of persons who, and animals and vehicles which, will constitute such parade; the type of animals, and a description of the vehicles;
H. 
The hour when such parade will start and terminate;
I. 
Whether such parade will occupy all or only one-half of the width of the streets proposed to be traversed;
J. 
The location by streets of any assembly or assembly areas for such parade;
K. 
The time at which units of the parade will begin to assemble at any such assembly area or areas;
L. 
The interval of space to be maintained between units of such parade;
M. 
If the parade is designed to be held by, and on behalf of or for, any person other than the applicant, the applicant for such permit shall file with the chief of police a communication in writing from the person proposing to hold the parade authorizing the applicant to apply for the permit on his behalf.

The chief of police shall grant and issue such parade permit if, from a consideration of the application and such other information as may otherwise be obtained, the chief of police finds that:
A. 
The conduct of such parade will not substantially interrupt the safe and orderly movement of other traffic contiguous to its route;
B. 
The conduct of such parade will not require the diversion of so great a number of police officers of the city to properly police the line of movement and the areas contiguous thereto, as to prevent normal police protection to the city;
C. 
The conduct of such parade will not require the diversion of so great a number of ambulances as to prevent normal ambulance service to portions of the city other than that to be occupied by the proposed line of march and areas contiguous thereto;
D. 
The concentration of persons, animals and vehicles at assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such assembly areas;
E. 
The conduct of such parade will not interfere with the movement of fire-fighting equipment en route to a fire;
F. 
The conduct of such parade is not reasonably likely to cause injury to persons or property;
G. 
Such parade will move from its point of origin to its point of termination expeditiously and without stopping en route; and
H. 
Such parade is not to be held for the sole purpose of advertising any product, goods or event, and is not designed to be held purely for private profit.

Each parade permit shall state the following:
A. 
Starting time;
B. 
Minimum speed;
C. 
Maximum speed;
D. 
Maximum interval of space to be maintained between the units of such parade;
E. 
What portions of the street to be traversed may be occupied by such parade;
F. 
Maximum length of such parade in miles or fractions thereof.

The chief of police shall act upon the application for a parade permit within eight days after the filing of the same. If the chief of police disapproves the application, he shall mail to the applicant within ten days after the date upon which such application was filed, a notice of his action, stating in general terms the reasons for his denial of the permit.

Any appeal to the council from the chief of police's denial of a parade permit must be taken within five days after notice of such denial, and the council shall act upon said appeal within ten days thereafter.

The chief of police, in denying any application for a parade permit, may authorize the conduct of such parade on a date, at a time, or over a route different from that named by the applicant, and if the applicant desires to accept the proposed date, time and route, he shall, within two days after notice of the action of the chief of police, file a notice of acceptance with the chief of police.

Immediately upon the issuance of a parade permit, the chief of police shall send a copy thereof to the following:
A. 
The fire chief;
B. 
The city engineer and street superintendent;
C. 
The postmaster of the Hawthorne Post Office;
D. 
The general manager or responsible head of each public transportation utility, the regular route of whose vehicles will be affected by the route of the proposed parade.

Upon the issuance of any parade permit, the chief of police, in cooperation with the director of public works and the street superintendent, shall designate and mark observation points along the parade route or site for exclusive use during the parade by disabled persons, as defined by 42 U.S.C. Section 1382c or such legislation as may hereinafter be enacted to supersede 42 U.S.C. Section 1382c. The observation points shall be so located and marked as to allow all disabled persons who are anticipated to be spectators an unobstructed view of the parade.

Any person who is not disabled within the meaning of 42 U.S.C. Section 1382c or such legislation as may hereinafter be enacted to supersede 42 U.S.C. Section 1382c who during a parade, occupies an observation point designated and marked as provided by Section 9.38.110 is guilty of an infraction and is punishable by a fine of not less than fifty dollars. Except that this provision shall not apply to any person accompanying a disabled person for the purpose of assisting that disabled person.

No person shall join or participate in any parade for which a permit is required by the provisions of Section 9.38.050, nor in any manner interfere with its progress or orderly conduct, without the consent of the person holding the permit to conduct or manage such parade.

A. 
Smoking of any tobacco product or lighted tobacco paraphernalia shall be prohibited at all parades and parade routes held pursuant to Chapter 9.38. Smoking is defined in Section 8.48.010.
B. 
Posting of Signs. The city shall cause the installation of "No Smoking" signs along parade routes, with letters of no less than one inch in height and including the international "No Smoking" symbol consisting of a pictorial representation of a burning cigarette enclosed in a red circle crossed by a red bar. Such signs shall be clearly and conspicuously posted and maintained at all main entrances to the parade or parade route and additional signs shall be posted in a quantity and manner reasonably likely to inform individuals along the parade route that smoking is prohibited at the parade.

A. 
The remedies provided by this chapter are cumulative and in addition to any other remedies available at law or in equity.
B. 
A violation of this chapter is subject to a civil action brought by the city attorney, punishable by a civil fine not less than one hundred dollars and not exceeding one thousand dollars per violation.
C. 
A violation of any provision of this chapter may, in the discretion of the city attorney, be prosecuted as an infraction or misdemeanor. The city council shall, by resolution, establish the penalties for a violation of this chapter, but in no event shall such penalties exceed the maximum penalties permitted under state law.
D. 
Causing, permitting aiding, abetting or concealing a violation of any provision of this chapter shall also constitute a violation of this chapter.
E. 
Any violation of this chapter is hereby declared to be a public nuisance.
