Section [A] 101.4 of the 2022 California Building Code is amended to add a second paragraph as follows:
The most recently adopted California State and the Hawthorne Municipal Code will take precedence.

Section 104.12 is added to the 2022 California Building Code to read as follows:
104.12 Authority. The Building Official shall have the authority to adopt rules and regulations to clarify and interpret the provisions of this ordinance. The Building Official may also approve variations and omissions when such variations or omissions are not detrimental to the life, health, safety, or welfare of the public, and do not violate the intent or purpose of this code.

Section [A] 105.3.2 of the 2022 California Building Code is amended to read as follows:
[A] 105.3.2 Time limitation of application. An application for a permit for any proposed work shall be deemed to have been abandoned 180 days after the date of filing unless such application has been pursued in good faith or a permit has been issued. The building official is authorized to grant one or more extensions of time for additional periods not exceeding 90 days each. The extension shall be requested in writing and justifiable cause demonstrated. No application shall be extended more than two years from the original date of the submittal. Where an extension is granted, additional fees may be applicable.
In order to renew an expired application, the applicant shall resubmit construction documents and pay for a new plan review fee. The construction documents shall be reviewed under the codes and ordinances that are current at the time of the resubmittal.

Section [A] 109.4 of the 2022 California Building Code is amended to read as follows:
[A] 109.4 Work commencing before permit issuance. Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to a fee established by the Building Official and the most current City Fee Schedule in addition to the required permit fees.
Investigation. Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation may be required before a permit may be issued for such work.
Investigation fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal up to the amount of the permit fee required by this code as determined by the Building Official. The investigation fee shall be determined by the most current City Fee Schedule. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law.

Any person who violates a provision of the codes listed in Title 15 or fails to comply with any of the requirements there-of or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the building official, or of a permit or certificate issued under the provisions of this title and the adopted codes, shall be subject to the penalties as prescribed by law. Every person who willfully resists, delays, obstructs or interferes in any way with any city building inspector in the discharge or attempt to discharge any duty of his or her office or employment shall be guilty of a violation of this chapter.
Any person, firm, or corporation violating any of the provisions or failing to comply with any of the mandatory requirements of the code of Hawthorne shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the code of Hawthorne shall be punished by a fine of not more than one thousand dollars, or by imprisonment not to exceed six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the code of Hawthorne is committed, continued, or permitted by any such person, and shall be punished accordingly.
