(a) 
Definitions.
"Beach"
means the public beach or shoreline area bordering the Pacific Ocean, owned, managed or controlled by the State of California, County of Los Angeles or the City of Redondo Beach or that is open to the general public and located within the City of Redondo Beach. For the purposes of this section, the beach shall include all indoor and outdoor areas of the land in the City that extends 1,000 feet seaward from the low mean tide line and landward to the following described lines: to the top of the seaward face of the coastal bluffs west of the Esplanade from the City's southerly border to the southerly edge of the first residential private property on the west side of the Esplanade and to the westerly edge of the private properties on the west side of the Esplanade from Avenue A to Ainsworth Court at George Freeth Way; to the westerly edge of the public sidewalk from Ainsworth Court to the extended line of the southerly edge of the Redondo Beach Pier; to the westerly foundation under the Pier from the southerly edge of the Pier to the southerly edge of the Harbor entrance break wall; from the westerly edge of the road, parking lot or buildings bordering the sandy area from the northerly edge of the Galveston Wall to the City's northern border.
"Parking area"
means a parking lot or any other area designated or primarily used for parking vehicles of persons accessing a recreational area.
"Recreational area"
means any outdoor area, owned or operated by the City of Redondo Beach open to the general public for recreational purposes, regardless of any fee or age requirement, including, but not limited to: parklands, including portions of parks, such as picnic areas, playgrounds, or sports fields; walking paths; gardens; hiking trails; the North Redondo Beach bike path; Class I bikeways as defined in Section 890.4 of the California Streets and Highways Code; athletic fields; skateboard parks; and amusement parks.
"Smoke" or "smoking"
shall mean holding or carrying any lighted pipe, cigar, cigarette, or any other lighted smoking product or equipment used to burn any tobacco products, weed, plant or other combustible organic or chemical substance of any kind or the lighting of any pipe, cigar, cigarette, or any other smoking product or equipment used to burn any tobacco products, weed, plant or other combustible organic or chemical substance of any kind. Smoking includes emitting, inhaling or exhaling the fumes of any pipe, cigar, cigarette, or any other smoking product or equipment the smoke from which is specifically designed or intended to be inhaled or drawn into the nose or mouth.
(b) 
No person shall smoke within the boundaries of a beach as defined in subsection (a) above.
(1) 
The provisions of this section shall apply to all ocean beaches in the City and shall include all jetties and breakwalls extending into or adjacent to the Pacific Ocean and Harbor, all access stairways and ramps, and all bicycle or pedestrian paths adjoining beach areas whether publicly or privately owned or maintained for the use of the general public by the State of California, or by any department thereof, or by any other public body.
(2) 
Permitted activities, including, but not limited to, filming and special events, may be exempted from this prohibition by permit.
(3) 
This section shall not apply to the municipal piers.
(4) 
This section shall not apply to the waterways, floats, wharves, docks and other facilities in the Redondo Beach King Harbor.
(c) 
No person shall smoke anywhere in a recreational area or in any parking area designated or primarily used for parking vehicles of persons accessing a recreational area.
(d) 
Causing, permitting, aiding, abetting, or concealing a violation of any provision of this chapter shall also constitute a violation of this chapter.

(a) 
No ash can, ashtray, or other smoking waste receptacle shall be placed in any area in which smoking is prohibited by this chapter.
(b) 
"No Smoking" signs, with letters of no less than one inch in height and including the international "No Smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle crossed by a red bar) shall be clearly and conspicuously posted and maintained at all main entrances to a recreational area and parking area and additional signs shall be posted in a quantity and manner reasonably likely to inform individuals occupying the recreational area and parking area that smoking is prohibited within the area.
(c) 
The presence of smoking waste receptacles in violation of subsection (a) above and the absence of signs required by subsection (b) above shall not be a defense to a violation of any provision of this chapter.
(d) 
No person shall intimidate, threaten any reprisal, or effect any reprisal, for the purpose of retaliating against another person who seeks to attain compliance with this chapter.
(e) 
Each instance of smoking in violation of this chapter shall constitute a separate violation.
(f) 
This chapter shall not be interpreted or construed to permit smoking where it is otherwise restricted by other applicable laws.

(a) 
The remedies provided by this chapter are cumulative and in addition to any other remedies available at law or in equity.
(b) 
Each violation of Section 5-8.01 is an infraction subject to the penalties described in Title 1, Chapter 2, Section 1-2.02(b) of this code.
(c) 
Each violation of Section 5-8.02(a) is an infraction subject to the penalties described in Title 1, Chapter 2, Section 1-2.02(b) of this code.
(d) 
Violation of Section 5-8.02(d) is a misdemeanor subject to the penalties described in Title 1, Chapter 2, Section 1-2.02(a) of this code.
