An Article to establish proper controls over the use of County parks, except for Lydgate Park, so that the people will have the optimum use and enjoyment of the parks.

This Article shall be known as and may be cited as the "Camping Ordinance."

(a) 
Any person who camps, erects a tent or constructs any temporary sleeping quarters on any County public park during the hours of 5:00 p.m. to 10:00 a.m. shall first obtain a camping permit from the Department of Parks and Recreation or any other authorized County agency.
(b) 
Except as authorized in Sec. 19-2.7 of this Article, permits shall be issued during normal hours of work of the County from the Department of Parks and Recreation or other agency that is designated by the Department.

The Department of Parks and Recreation shall issue a camping permit upon the following terms and conditions:
(a) 
Each permittee for camping, except those persons and organizations who are exempt under Sec. 19-2.5 of this Article or those persons who are found camping without a permit and who are issued a permit in accordance with Sec. 19-2.7 of this Article, shall pay the sum of three dollars ($3.00) per person camping, per night.
(b) 
Each permittee shall leave the premises in a sanitary, clean and orderly condition.
(c) 
No permit shall be issued to allow camping and no one shall be allowed to camp for more than seven (7) consecutive days at any campsite.
(d) 
Each camper shall be limited to sixty (60) camping days per year-long period.
(e) 
Each permittee must show or display the permit to any authorized County officer or employee.
(f) 
Permits shall be issued individually.

Any person who provides a statement under oath of his or her continued and present residency in the State of Hawai'i for a period of one (1) year, or who is a resident as defined in Sec. 235-1, Hawai'i Revised Statutes, and all members of eleemosynary groups, organizations, associations or clubs, duly organized and registered under the laws of the State of Hawai'i, including all public and private school clubs, associations, organizations and groups which are recognized by the Department of Education of the State of Hawai'i, and children below eighteen (18) years of age, are exempted from the payment of any fees as provided in this Article, provided, applications for permits must be submitted and approved, and the number and names of the persons comprising the group shall be recorded.

Animals are prohibited from being brought into the camping area. The County park caretaker, or other County employee authorized by the Director, may ask that the animal be removed from the camping area, and for failure to comply therewith, the park caretaker or other County employee may summarily revoke the camping permit.

Any person found camping without a permit by the County employee authorized by the Director, may be evicted from the County park or, when a permit would otherwise be authorized to be issued, the County employee may issue a camping permit for one (1) night only upon the payment of a permit fee in the sum of five dollars ($5.00). Any person paying such fee shall not be subject to the penalties prescribed in Sec. 19-2.8 of this Article; provided, however, that in the event such person desires a permit for more than one (1) night, he or she shall obtain a camping permit pursuant to Sec. 19-2.4 of this Article on the day immediately following the issuance of a permit in accordance with this Section.

Any person found camping in the County parks without a camping permit shall be punished by a fine not exceeding one hundred dollars ($100.00). Each day of violation shall be a separate offense.
