For purposes of this development code, certain words, phrases and terms used herein shall have the meaning assigned to them by this chapter. When not inconsistent with the context, words used in the present tense include the future; words in the singular number include the plural and those in the plural number include the singular. The word "shall" is mandatory and not discretionary; the word "may" is permissive and discretionary.

"A" Definitions and Illustrations.
means a portable temporary advertising device which is commonly in the shape of an "A," or some variation thereof, is located on the ground, is easily movable, and is usually two-sided.
means the cessation of or suspension from developing or maintaining a building or use for a stated period of time.
means a business or activity with no reported sales or production for a period of at least one hundred eighty days. Exceptions are temporary closures for repairs, alterations or similar situations.
means a parcel of land having a common boundary with another parcel of land including parcels which have no common boundary other than a common corner.
means safe, adequate and usable ingress or egress to a property in use.
means a building or structure detached from, on the same lot as, and customarily incidental and subordinate to the principal building.
means a use of land or of a building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with such principal use.
"Gross acreage" means the total area within the lot lines of a lot or parcel of land before public streets, easements or other areas to be dedicated or reserved for public use are deducted from such lot or parcel, and do not include adjacent lands already dedicated for such purposes.
"Net acreage" means the gross project or lot area, less that portion of the site to be used for arterial and collector roads and/or the floodway portion of a flood plain.
means any construction that is attached to an existing building and which increases the size of a building or facility in terms of site coverage, height, length, width or gross floor area.
means any person showing written verification that he or she is acting for, and with the knowledge and consent of, a property owner.
means housing for agricultural workers that may include, but is not limited to, conventionally constructed units and manufactured housing consisting of no more than thirty-six beds in group quarters (or twelve units or less) designed for use by a single family or household.
means land with a minimum lot size of five acres that is used for the purpose of producing an agricultural commodity for commercial purposes. "Agricultural commodity" means any and all plant and animal products produced in this state for commercial purposes. An agricultural use can occur wholly, or in part, in a greenhouse.
means the use of land for the production of food and fiber, including the growing of crops and/or the grazing of animals on natural prime or improved pasture land.
means any area which is used or intended to be used for the taking off and landing of aircraft, including helicopters, and any appurtenant areas which are used or are intended to be used for airport buildings or facilities, including open spaces, taxiways and tie-down areas.
means an establishment that produces or manufactures alcoholic beverages and is licensed by the Department of Alcoholic Beverage Control of the State of California. These type of establishments may: (1) sell alcohol that is produced or manufactured on the alcoholic beverage manufacturer's licensed premises for on-sale or off-sale consumption; (2) include accessory uses such as tours, specialty dinners, food pairings, retail sales, and/or on-site consumption; and (3) include tasting rooms. Typical uses include breweries, distilleries and wineries.
Accessory uses may include one "mobile food facility," sometimes referred to as a "food truck," as defined by Riverside County Ordinance 580, as may be amended from time to time. Said mobile food facility shall be subject to and required to comply with the provisions of all city, county, state, and federal regulations applicable to mobile food facilities and maintain all current licenses, insurance, permits and/or approvals required from such regulations and presented to law enforcement or city staff upon request.
means any premises, place or building which is maintained and operated exclusively to provide twenty-four hour residential nonmedical services to adults, which may include, but need not be limited to, emancipated minors who are mothers under eighteen years of age and their children, who are recovering from problems related to alcohol, drug, or drug and alcohol misuse or abuse and who need alcohol, drug or drug and alcohol recovery treatment or detoxification services.
means a narrow service way, either public or private, which provides a permanently reserved but secondary means of public access not intended for general traffic circulation. Alleys typically are located along rear property lines.
means any change or rearrangement in the supporting members of an existing building, such as bearing walls, columns, beams, girders or interior partitions, as well as any change in doors or windows, or any enlargement to or diminution of a building or structure, whether horizontally or vertically, or the moving of a building or structure from one location to another. Alternation for signs include any change of face, color, material, size, shape, illumination, position, location, construction, or support of any sign or advertising device.
means a balloon, supported by forced air (non-helium), construction of fabric materials, affixed to the ground or roof top using steel cable anchoring systems, and often containing advertising messages.
means a natural or man-made feature which enhances a particular property.
unless otherwise stated, means and includes birds, fish, mammals and reptiles.
means uses such as frog farms; worm farms; the keeping and raising of more than four chinchillas, nutria, hamsters, guinea pigs, cavy, rabbits and similar small animals; and the keeping and raising of exotic animals, including the keeping of exotic animals as pets.

means any system of wires, poles, rods, reflecting discs, or similar devices used for the transmission or reception of electromagnetic waves when such system is either external to or attached to the exterior of a structure. Antennas shall include devices having active elements extending in any direction, and directional beam-type arrays having elements carried by and disposed from a generally horizontal boom that may be mounted upon and rotated through a vertical mast or tower interconnecting the boom and antenna support, all of which elements are deemed to be a part of the antenna. Antennas shall include cellular on wheels (COWs) and cellular on light trucks (COLTs) facilities; as well as dispatch carriers for specialized mobile radio (SMR) services and enhanced SMR (ESMR).
"Antenna—building mounted"
means any antenna, other than an antenna with its supports resting on the ground, directly attached or affixed to a building, tank, tower, or structure other than a telecommunication tower.
"Antenna—directional"
(also known as a "panel" antenna) transmits and/or receives radio frequency signals in a directional pattern of less than three hundred sixty degrees.
"Antenna—ground mounted"
means any antenna with its base, single or multiple posts, placed directly on the ground or a mast less than ten feet tall and six inches in diameter.
"Antenna—vertical"
means a vertical type antenna without horizontal cross-sections greater than three-quarters of an inch in diameter.
means one or more rooms with a private bath and kitchen facilities comprising an independent self-contained dwelling unit in a building containing more than two dwelling units.
means a structure containing three or more apartment units which is intended for rental purposes.
means a person who requests in writing the approval of a lease, permit, license, certificate or other entitlement from public agencies.
means the form and information submitted by an applicant for purposes of requesting an entitlement to use or develop property.
"Complete application" means a development request or application that provides all the required and necessary materials for effectively reviewing the permit request. The planning director shall have the authority to determine if an application, as submitted, is complete.
means an integrated component of the design of a building, including walls, windows, entryways, rafters, roofs and other typical components.
means a field established for non-professional recreational activities such as youth sports and adult recreational leagues.
means any structure that has an interior wall or roof in common with another structure.
means a temporary sign which is mounted, placed or attached only to the permanent building where the business activity is conducted.
means an establishment which performs hand-washing, waxing and interior cleaning of passenger vehicles.
means an area with multiple automobile/truck dealers which sells new and used automobiles and/or trucks of one ton or less capacity, including the repairing of same, in a planned area of ten acres or greater. The definition does not limit the ability to subdivide parcels in a planned auto mall in accordance with the city's development standards.
means the existing freeway oriented auto mall center identification sign including the electronic message board, located on 26631 Ynez Road.
means a retail place of business engaged primarily in the sale of petroleum products, goods and services required in the operation and maintenance of motor vehicles under one and one-half ton capacity as the same is defined by the Vehicle Code by the state and in which maintenance, minor repairs, washing, and lubrication services are conducted wholly within the service station building.
means the dismantling or wrecking of one or more used motor vehicles or trailers; or storage, sale or dumping of one or more dismantled, partially dismantled, obsolete or wrecked vehicles or their parts.
means the use of any building, land area or other premises for the display and sale of new or used automobiles, panel trucks, vans, trailers or recreation vehicles including any repair service conducted as an accessory service.
means a facility which sells automobiles and/or trucks of one ton or less capacity, both new and used, including the repairing of same. Trucks of more than one-ton capacity shall not be included in this term.
means an operation or business that buys, stores, and/or sells used vehicles and/or their parts. This includes dismantling vehicles and machines to sell parts as used car parts or scrap metal, to include refurbishment of parts.
means a painted or silkscreened, non-electric sign attached to an awning or canopy attached to the exterior of a building.

means any bunting, plastic, paper or similar material used for advertising purposes that is attached to any structure, staff, pole, line, framing, vehicles or any other similar object.
means the flood having a one percent chance of being equaled or exceeded in any given year, a.k.a. one-hundred-year flood.
means a space wholly or partly underground and having more than one-half of its height, measuring from its floor to its ceiling, below the average adjoining grade; if the finished floor level directly above a basement is more than six feet above grade, such basement shall be considered a story.
means usually a dwelling unit, but sometimes a small hotel, which provides lodging and breakfast for temporary overnight occupants for compensation.
means any habitable room other than a bathroom, kitchen, dining room or living room.
means a retail market that specializes in the sale of beer and wine for off-sale consumption as regulated by the state of California Alcohol Beverage Control Type 20 license. The sale of beer and wine products is the predominant product sold in such facility and the sale of other goods and services is not required. There are no size criteria or limitations on such facilities.
means a mound or embankment of earth, usually two to six feet in height.
means a corridor expressly reserved for bicycles, existing on a street or roadway in addition to any lanes for use by motorized vehicles.
means a paved route not on a street or roadway and expressly reserved for bicycles traversing an otherwise unpaved area. Bicycle paths may parallel roads but typically are separated from them by landscaping.
means a facility shared with motorists and identified only by signs; a bicycle route has no pavement markings or lane stripes.
means a term that encompasses bicycle lanes, bicycle paths and bicycle routes.
means a sign which directs attention to a business, commodity, service or entertainment conducted, sold or offered at a location other than the premises on which the sign is located.
means a unit of land bounded by streets or by a combination of streets and public land, railroad rights-of-way, waterways or any other barrier to the continuity to development.
means the individual or group duly authorized to grant changes to, relief from or special consideration under this development code.
means an establishment that is used for the regular service of meals to patrons. The establishment shall have suitable kitchen facilities and provide an assortment of foods commonly ordered at various hours of the day.
means an area of land separating two distinct land uses that acts to soften, mitigate or protect the effects of one land use on the other.
"Minimum buildable area" means the area within the lot lines that remains after subtracting the front, side and rear setback areas.
means any structure used or intended for supporting or sheltering any use or occupancy.
means the percentage of the net lot area which is covered by all the buildings on a lot as seen from a plan view.
means the length of the building elevation(s) which fronts on a public street, public parking lot or major pedestrian walkway.
means the vertical distance by which a building extends above the pre-existing grade, finished grade or floor protection elevation, whichever is lower, to the highest point of the coping of a flat roof, or to the deck line of a mansard roof, or to the average point of the highest and lowest points of a gable, hip or gambrel roof. Screened mechanical and electrical towers, chimneys, and other integral parts of the building or structure occupying no more than five percent of the roof area shall be excluded from the measurement.
"Historic building" means a building listed individually on the National Register of Historic places, or by a state or county agency charged with recognition or preservation of historic structures, or by resolution of the city council as having significant local or regional historical importance and value to the community.
"Main building" means a building within which is conducted the principal use permitted on the lot as provided by this development code.
means the building official of the city of Temecula or the authorized representative.
means the level or graded area of a lot designated for the placement of the primary building or use and all accessory structures and uses.
means a lot or contiguous lots of land in single, multiple or joint ownership, which provides the area and open spaces required for construction of a building or buildings, and which abuts a public or private street, alley or easement.
means a group of three or more industrial establishments planned, constructed, and managed as a total entity with customer and employee parking provided on-site, provision for goods delivery separated from customer access, aesthetic considerations and protection from the elements.
means a paved indentation in the curb of a roadway designed to allow buses to stop while picking up and dropping off passengers.

Sometimes referred to as cabinet signs, a sign that is shaped like a box to enclose the source of illumination (internally illuminated) so that the light shines through the translucent portions of the sign's copy panel(s). Logo boxes are not considered can signs.
means a roofed structure providing space for the parking or storage of motor vehicles and enclosed on not more than one side.
means property, including mausoleums, which is used for the interring of the deceased.
means a sign that identifies the name of a center and is located at a center entrance.
of a street as referred to in this development code means the right-of-way centerline as established by the county engineer of the county, by the city engineer of the city, by the State Division of Highways of the state; in any case in which the foregoing definition is not applicable, the planning commission shall designate the centerline.
means a document issued by the director of building inspection allowing the occupancy or use of a building and certifying that the structure or use has been constructed or will be used in compliance with all the applicable municipal codes and ordinances.
mean individual three-dimensional letters or figures that are affixed to a building or a freestanding sign structure.
means an assemblage of people for worship or an institution facilitating worship, including personal counseling and education and the building or buildings where such activities take place.
means the city of Temecula.
means development in which a number of dwelling units are placed in closer proximity than usual, or are attached, with the purpose of retaining an open space area.

means any building, structure, enclosure, or premises whereupon, or within which, five or more cats four months of age or older are kept or maintained, for financial profit for the purpose of boarding, breeding, training, marketing, hire or any other similar purpose.
include neighborhood, community, highway/tourist, and service commercial zoning designations or their equivalent specific plan zoning designation.
means any building, structure, enclosure, or premises whereupon, or within, five or more dogs four months of age or older are kept or maintained, for financial profit for the purpose of boarding, breeding, training, marketing, hire or any other similar purpose.
means any sign structure advertising an establishment, merchandise or entertainment, which is not sold, produced, manufactured or furnished at the property on which the sign is located. Commercial off-premises signs are commonly known or referred to as billboards.
means an activity, which includes the buying and selling of commodities and services.
means land in a residential, commercial, industrial or similar development held in common and/or single ownership which is available for use by all owners and tenants and guests and invitees thereof, and which is not reserved for the exclusive use or benefit of an individual tenant or owner.
means any facility, place or building which is maintained and operated to provide nonmedical residential care, day treatment, adult day care or foster family agency services for children, adults, or children and adults, including, but not limited to, the physically disabled, mentally impaired, incompetent persons, and abused or neglected children, and includes residential facilities, adult day care facilities, day treatment facilities, foster family homes, small family homes, social rehabilitation facilities, community treatment facilities, and social day care facilities.
means a facility operated by the city which provides recreational, cultural or other similar activities.
means a design feature combining landscaping, hardscaping, architectural features, public art, signs, or any other creative feature that can be considered a special and unique design for locations that are considered major intersections or highly visible locations within the city.
identifies the name and/or logo of a specific plan. A neighborhood identification sign identifies the name and/or logo of a subdivision, mobile home park or multifamily complex.
means a use permitted in a particular zoning district only upon showing that such use in a specified location will comply with all the conditions and standards for the location or operation of such use as specified in this development code and authorized by the planning commission.
means a discretionary entitlement which may be granted under the provisions of this development code and which, when granted, authorizes a specific use on a specific property subject to special terms and conditions.
means apartment housing, usually for senior citizens, or for the disabled in accordance with Health and Safety Code Section 50062.5 which is arranged in a group setting that includes independent living and sleeping accommodations in conjunction with shared dining and recreational facilities.
means a facility with a noninstitutional, home-like environment which provides inpatient care, including the following basic services: medical supervision, twenty-four hour skilled nursing and supportive care, pharmacy, dietary, social recreational, and at least one type of service specified in the Health and Safety Code. The primary need of congregate living health facility residents shall be for availability of skilled nursing care on a recurring, intermittent, extended or continuous basis. This care is generally less intense than that provided in general acute care hospitals but more intense than that provided in skilled nursing facilities.
means a temporary sign which states the name of the individual(s) and/or firms connected with the construction or financing of a project.
means a state-licensed facility which provides long-term nursing, dietary and other medical services except surgery or primary treatments customarily provided in a hospital, to convalescents or invalids.
means a retail food market providing goods and other services on an extended-hour basis. The sale of beer and wine is allowed with an approved conditional use permit. Such stores are located in smaller commercial centers or along major roadways with easy accessibility.
means a flag of a nationally recognized corporation or company. Individual businesses with franchise agreements or individually operated business of larger company are not be included in this definition.
means any open space, unobstructed from ground to sky, other than a yard, that is on the same lot with and bounded on two or more sides by the walls of a building.
means an entrance used by customers and patrons excluding loading entrances.

means any child day care facility other than a family day care home but including infant centers, preschools and extended day care facilities.
means bright fluorescent appearing colors, excluding signs illuminated by neon.
means consecutive calendar days, unless otherwise specified.
means a unit used to express the intensity of a sound wave.
means a flag or banner attached to light poles or other objects in a shopping center that provides a festive atmosphere to the center by colors, graphics, etc., and does not provide advertising space.
means the conveyance by an owner or developer of private land for public use, and the acceptance of land for such use by the governmental agency having jurisdiction over the public function for which it will be used.
means to remove more than seventy-five percent of the exterior walls of an existing building or structure, as measured by the linear length of the walls.
means the number of residential dwelling units per net acre of land.
means the density increase over the otherwise maximum allowable gross residential density as of the date of application by the applicant, or, if elected by the applicant, a lesser percentage of density increase, including, but not limited to, no increase in density. The amount of density increase to which the applicant is entitled shall vary according to the amount by which the percentage of affordable housing units exceeds the percentage established in subdivision (b) of California Government Code Section 65915.
means a method of retaining open space by concentrating densities in compact areas adjacent to existing urbanization and utilities while leaving historic, sensitive or hazardous areas unchanged.

means a building which does not have a wall of four feet or more in length in common with another building.
means a temporary sign which is partially attached to a permanent building, or is attached to a temporary structure such as a pole or pipe, or any combination of the above. Detached temporary signs do not include portable or vehicle mounted signs.
means an individual or business that prepares new land for the construction of buildings or causes physical building space to be built for use primarily by others, and in which the preparation of the land or the circulation of the building space is, in itself, a business and is not incidental to another business or activity.
means the physical extension and/or construction of urban land uses on land, in or under water. Development activities include: subdivision of land; construction or alteration of structures, roads, utilities and other facilities; installation of septic systems; grading; deposit of refuse, debris or fill materials; and clearing of natural vegetative cover.
means a unified text incorporating those areas of regulation more typically presented in separate zoning and subdivision ordinances and related chapters, hereafter referenced as the "development code."
means a map or maps along with supporting text, data, statistics or tables which describe the entitlement and its associated conditions which are authorized for a described parcel of land.
means the comprehensive evaluation of a development and its impact on neighboring property and the community as a whole, from the standpoint of site and landscape design, architecture, materials, colors, lighting, and signs, in accordance with a set of adopted criteria and standards.
means any of the uses, activities or structures listed under the definition of "development" when carried out, undertaken or established individually or independently of any other such use, activity or structure; or any group or combination of the listed uses, activities or structures which combine to form, or are a component part of an integrated project.
means the director of community development of the city of Temecula or authorized representative.
means a freestanding, multiple-sided, sign structure whose main purpose is to display signs or information.
means any housing which is designed and constructed to accommodate physically disabled persons.
means the cessation or suspension of the use of property for a stated period.
means a store advertising a wide variety of merchandise for sale at less-than-retail cost.
means a use engaged primarily in storage wholesale and distribution of manufactured products, supplies, and equipment, including incidental storage and sales activities, but excluding bulk storage of materials which are flammable or explosive.
means a private roadway providing vehicular access to parking space, garage, dwelling or other structure.
means a structure or portion thereof which is used exclusively for permanent human habitation.
"Duplex dwelling" means a detached building that is designed for occupation as the residence of two families living separate from each other.
"Multifamily dwelling" means a building or portion thereof and/or designed as a residence with two or more separate dwelling units.
"Single-family attached dwelling" means a dwelling unit occupied or intended for occupancy by only one household that is structurally connected with at least one other such dwelling unit (examples, townhouse or condominium).
"Single-family detached dwelling" means a detached building on a separate lot containing no more than one kitchen which, regardless of form of ownership, is designed and/or used to house not more than one family including all domestic employees of such family.
"Stacked dwelling" means an attached multiple-family building that is two stories or more in height. Individual dwelling units occupy a single floor and are located above or below another dwelling unit.
"Townhouse dwelling" means an attached dwelling, typically two stories in height, which is designed as a single-family residence. The dwelling units are to be attached by common walls to three or more similar dwellings.
"Triplex dwelling" means a detached building that is designed for occupation as a residence for three families living separately from each other with separate kitchens, baths, and living and sleeping areas, and entrances.
"Patio home dwelling" means a single-family unit on a separate lot which may be detached or attached on individual lots. One side of the dwelling may be located with a zero lot line setback on one side. Houses may be attached or the garage structures may be connected along this zero lot line setback.
means a group of three or more detached buildings used as one-family, two-family or multiple-family dwellings located on a single lot, together with all of the open spaces required by this development code but not including tourist courts, motor courts, or motels or any other commercial uses.
means a self-contained group of interconnected rooms designed, occupied or intended for occupancy as separate living quarters, with cooking, sleeping and sanitary facilities provided within the dwelling unit for the exclusive use of a single family maintaining a household.

means a grant of one or more of the property rights by the property owner to and/or for the use of the public, a corporation or another person or entity.

means a building's exterior wall which is exposed to public view.
means one or more persons living together as a single housekeeping unit in a single dwelling unit. Family also means the persons living together in a licensed residential facility, as that term is defined in California Health and Safety Code Section 1502(a)(1) serving six or fewer persons, excluding the licensee, the members of the licensee's family, and persons employed as facility staff who reside at the facility.
means a home (a detached single-family dwelling, a townhouse, a dwelling unit within a dwelling, or a dwelling unit within a multifamily dwelling in which the underlying zoning allows residential uses) which regularly provides care, protection, and supervision of fourteen or fewer children, in the provider's own home, whether the home is rented, leased or owned, for periods of less than twenty-four hours per day, while the parents or guardians are away. "Public parking area" means an area, other than a private parking area or street, used for the parking of vehicles and available for general public use, either free or for a fee.

means a vehicular portable structure without permanent foundation which can be towed, hauled or driven, which is primarily designed as a temporary living accommodation for recreational, camping or travel use and which may include, but is not limited to, travel trailers, truck campers, camping trailers and self-propelled motor homes.
means an area used or intended to be used for camping by recreational vehicles.

The rental of units within city-approved hotels, motels, bed and breakfasts, community care facilities, and social care facilities shall not be considered to be a short-term rental.

means a separate area on the alcoholic beverage manufacturer's licensed premises maintained and operated by and for an alcoholic beverage manufacturer, wherein alcoholic beverages may be sold and served by an employee or designated representative of the alcoholic beverage manufacturer to consumers of legal drinking age for consumption on the alcoholic beverage manufacturer's licensed premises. Alcoholic beverages manufactured elsewhere may not be sold in the tasting room or on the alcoholic beverage manufacturer's licensed premises. A tasting room is, and at all times shall remain, an ancillary use to the alcoholic beverage manufacturing use.

A ground, building, or tower mounted antenna operated by a federally licensed amateur radio operator as part of the Amateur Radio Service that is less than thirty-five feet in height;
A ground or building mounted receive-only radio or television satellite dish antenna, which does not exceed one meter (39.4 inches) in diameter;
Mobile services providing public information coverage of news events of a temporary nature;
Hand-held devices such as cell phones, business-band mobile radios, walkie-talkies, cordless telephones, garage door openers and similar devices as determined by the planning director; and
City government owned and operated receive and/or transmit telemetry station antennas for supervisory control and data acquisition (SCADA) systems for water, flood alert, traffic control devices and signals, storm water, pump stations and/or irrigation systems.
"Telecommunication facility—co-located"
means a telecommunication facility comprised of a single telecommunication tower or building supporting one or more antennas, dishes, or similar devices owned or used by more than one public or private entity.
"Telecommunication facility—multiple user"
means a telecommunication facility comprised of multiple towers or buildings supporting one or more antennas owned or used by more than one public or private entity, excluding research and development industries with antennas to serve internal uses only.
means a temporary sign which is made of cloth, bunting, plastic, wood, vinyl, poster board, painted windows or other similar materials, and which is located on site of the business use or activity, and is erected or placed for a prescribed period of time to promote, advertise, announce or provide the following information:

means an opening which is in a wall of a building, designed to allow light and/or ventilation into the building, enclosed by casement or sash and contains glass or other similar transparent or semi-transparent material.
means any sign which is painted, attached, glued or affixed to a window or is otherwise easily visible from the exterior of the building where the advertised product or service is available.

means an open space area on a lot that is unoccupied or unobstructed from the ground upwards, except as permitted by this development code.
"Actual front yard" means the space extending across the full width of the front of the lot, the depth of which is the minimum horizontal distance between the front lot line or street right-of-way line and the primary structure on the lot.
"Actual rear yard" means the space extending across the full width of the rear of the lot, the depth of which is the minimum horizontal distance between the rear lot line and the primary structure on the lot.
"Actual side yard" means the space between the setback line of the main building and the side lot line, extending from the front yard to the rear yard; the measured distance of the yard shall represent the shortest distance between the side lot line and that portion of the main building nearest the line from which the measurement is taken.
