Every establishment in the city of Sunnyvale where any pool
or billiard table or other legally permissible gambling device is
maintained for public use or hire shall be closed each morning between
the hours of two a.m. and six a.m. Every person who, whether as owner,
agent, employee or otherwise permits or allows any such establishment
to remain open, or being closed, permits any person or persons to
remain or enter therein and to play any legally permissible game with
cards, tables or other devices, or to make any purchase between the
hours of two and six a.m., is guilty of a misdemeanor, and upon conviction
thereof the license of the person operating such establishment shall
be forfeited.

Every person who deals, plays or carries on, opens, or causes
to be opened, or who conducts, either as owner or employee, whether
for hire or not, any game of skill or chance played with cards, dice,
or any device, for money, checks, credit, or other representative
of value, in any billiard or pool hall, store, hotel or other public
place in the city of Sunnyvale, and every person who plays or bets
at or against any such games, and every owner or person in control
of a billiard or pool hall, store, hotel or other public place who
permits or allows any such game to be played in his establishment,
is guilty of a misdemeanor. Provided, however, that an arrangement
between players of pool, billiards and similar games, played in a
public billiard or pool hall, whereby the loser is to pay the actual
rent or charge for the use of the implements with which the game is
played, shall not be construed to be a violation of this section.

It is unlawful for any person to play or bet at, in, on, or
against any game or device not mentioned in Section 330 of the Penal
Code of the state of California with cards, dice or any device for
money, checks, credit or other representative of value.

It is unlawful for any person, firm or corporation, either as
principal, agent, employee, or otherwise, to keep, conduct, or maintain
or to permit to be kept, conducted or maintained any house, room,
apartment or place in the city of Sunnyvale to be used in whole or
in part for any game or device not mentioned in Section 330 of the
Penal Code of the state of California which is played with cards,
dice or any device for money, checks, credit or other representative
of value.

This chapter shall not apply to any game of bingo conducted pursuant to the provisions of Chapter
9.37 of this code.
