The following words and phrases, whenever used in this chapter, shall be construed as defined in this section:
"Alcoholic beverage"
includes alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.
"Billiard room" or "pool hall"
means any establishment open to the public for the lawful playing of billiards, pool, snooker and other similar games, whether or not the playing of such games constitutes the principal business upon the premises. This definition only applies to those businesses which do not serve any alcohol, or serve alcohol with a type of state license which allows minors on the premises.
"Minor"
means any person under twenty-one years of age.

It is unlawful for any minor to be upon the premises of any billiard room or pool hall and any person owning, managing or operating such place shall not permit any minor to be upon such premises, except as hereinafter provided:
(a) 
Minors eighteen years of age or older may be permitted upon such premises at any time it is open to the public;
(b) 
Any owner, manager or operator may establish more restrictive hours for minors, or exclude minors;
(c) 
The director of public safety or the director's designee may require more restrictive hours for minors, or exclude minors from any particular billiard room, if it is determined that inadequate precautions exist to prevent criminal acts by or victimization of minors. Such acts include, but are not limited to:
(1) 
Possession or consumption of alcoholic beverages by minors;
(2) 
Fights or disorderly conduct occurring upon the premises;
(3) 
Possession, use, sale or drugs occurring upon the premises;
(4) 
Persons found to be under the influence of drugs on premises;
(5) 
Minors under eighteen years of age on the premises;
(6) 
Any acts which would lead to a "disorderly house" determination by the Alcoholic Beverage Control (Business and Professions Code Section 25601);
(7) 
Any time the license to sell alcoholic beverages is under administrative or criminal review, suspension or revocation.

No person shall prevent any city, state or federal peace officer, or fire prevention officer, or building official or inspector charged with the duty of enforcing the laws of their respective jurisdiction from having free access to the premises at all times it is open to the public and at all other reasonable times. Whenever the premises is occupied by any person shall be considered a reasonable time for the purposes of this section.
