(a) 
The city council finds that there has been a significant increase in vehicular traffic during the evening hours along major thoroughfares and adjacent peripheral streets in the city of Sunnyvale as a result of the activity known as "cruising."
(b) 
The city council finds that this cruising activity has been the direct cause of an increase in traffic congestion, injury and noninjury collisions, disturbance calls, alcohol and substance abuse, and Vehicle Code violations related to the cruising activity.
(c) 
The city council further finds that the cruising activity interferes with the conduct of ordinary business along the thoroughfares, is a waste of energy resources, impedes the progress of general traffic and emergency vehicles, and promotes the generation of air and noise pollution along the affected thoroughfares.
(d) 
It is the intent of the city of Sunnyvale to regulate cruising in accordance with the authority granted pursuant to Vehicle Code Section 21100(k).

The following words and phrases, whenever used in this chapter, shall be construed as defined in this section:
"Cruising"
shall mean the repetitive driving of a motor vehicle past a traffic control point in traffic which is congested at or near the traffic control point, as determined by the ranking peace officer on duty within the affected area, within a four-hour period after the vehicle operator has been given a written notice on a previous driving trip past the control point that further driving past the control point will be a violation of this chapter.
"Traffic control point"
shall mean a location along a public street or highway utilized as an observation point in order to monitor traffic conditions for potential violation of this chapter.
"Traffic congestion" or "congested traffic"
shall mean traffic on any public street or highway which is delayed to the point that:
(A) 
Motor vehicles cannot move through a four hundred forty-yard approach corridor to an intersection controlled by a traffic light within two complete green light cycles where the delay in forward movement is due to the position of other motor vehicles; or
(B) 
Motor vehicles cannot move through a four hundred forty-yard approach corridor to an intersection controlled by a traffic light within a one-minute period where the delay in forward movement is due to the position of other motor vehicles; or
(C) 
Motor vehicles cannot readily move forward on portions of public streets or highways between intersections because traffic speed has slowed to less than fifteen miles per hour, and the delay in movement is due to the position of other motor vehicles.

No person shall engage in the activity of "cruising" as defined in this chapter on any portion of public streets or highways which have been identified and posted with signs at the beginning and end of the street, or portion thereof, designating that street or portion thereof to be subject to cruising controls in accordance with this chapter and Section 21100(k) of the California Vehicle Code.

A written notice may be issued to any person operating or occupying any motor vehicle that passing a traffic control point within a subsequent four-hour period will be a violation of the city of Sunnyvale's cruising ordinance.

The street or portion thereof that has been designated to be subject to cruising controls pursuant to this chapter and Section 21100(k) of the California Vehicle Code shall be posted at the beginning and end of the affected portion of the street with signs which reference the appropriated provisions of Vehicle Code Section 21100(k) and this chapter.

Any person who is convicted for violation of this chapter shall be guilty of an infraction, and upon conviction thereof shall be punished as set forth in Chapter 1.04 of this code.
