No more than four dogs over the age of four months shall be kept at or upon any premises or dwelling unit without first securing from the animal control officer a license to operate a kennel regardless of the number of persons residing in such dwelling unit.

The animal control officer shall issue a license to operate a kennel only under the following conditions:
A. 
When the premises on which the kennel will be located complies with the provisions of the zoning code of the city;
B. 
When the premises on which the kennel will be located is of sufficient size to accommodate, in the opinion of the animal control officer, the number of dogs which the owner of such kennel anticipates will be on the premises, without causing any disturbance or annoyance to persons in the surrounding area;
C. 
The applicant has prepared and submitted to the city an animal natural disaster evacuation plan covering the kennel to be operated under the license;
D. 
No kennel may exist upon any property zoned for residential use.

The fee for the issuance of a kennel license shall be established by resolution adopted by the city council, as amended from time to time. Such fee shall be in addition to all fees required for the licensing of each individual dog kept at the kennel. Nothing herein shall be read to permit any dog kept at any kennel to remain unlicensed.

A. 
A kennel license may be revoked by the animal control officer when he or she determines any of the following: area;
1. 
That the dogs in the kennel are causing continual annoyance and disturbance to persons in the surrounding
2. 
That the dogs within the kennel are not being given proper care;
3. 
That circumstances have changed since the issuance of the kennel license, and in view of such circumstances, the premises are no longer suitable for the operation of a kennel.
B. 
Any person whose license to operate a kennel is revoked by the animal control officer may appeal such determination to the city council within 10 days after written notice of such revocation is given by the animal control officer. The appeal must be filed with the city clerk in writing.

A. 
The animal control officer may, prior to issuing a kennel license, attach such reasonable conditions as he deems necessary to insure that the operation of the kennel will not be a detriment to the public health, safety and welfare.
B. 
The animal control officer may, in lieu of revocation of a kennel license, place such conditions on the license as may be necessary to permit the license holder to continue to have a kennel while protecting the public health, safety and welfare.
