Any outdoor burning of any material of any kind or nature whatsoever, including, but not limited to, garbage, trash, junk, vehicles or boats, refuse, rubbish, weeds, limbs or brush, or domestic or other material is prohibited within the city limits, unless specifically allowed hereunder as an exception.

(a) 
The following materials and activities are excepted from section 6.04.001, above, but only if such outdoor burning is in strict compliance with the provisions of the Texas Clean Air Act, title 30 of the Texas Administrative Code, this article, and other applicable law:
(1) 
Firefighter training, if the appropriate authorization is obtained from the Texas Commission on Environmental Quality or other appropriate authorities;
(2) 
Outdoor burning for noncommercial preparation of food at a private residence so long as the food preparation is conducted in a manufactured, closable grill, smoker, or similar device in accordance with manufacturer's instruction; and
(3) 
Warming fires at a private residence, but only in gas-fueled portable or fixed containers, fireplaces, specifically manufactured or constructed for warming fires in accordance with the manufacturer's or builder's instructions, and only so long as such fires are not offensive or objectionable to third parties due to atmospheric conditions or local circumstances that make such fires otherwise hazardous, the container, or fireplace is on open soil or a concrete slab, fire-extinguishing equipment, such as dirt, sand, a water barrel, garden hose, or fire extinguisher is available for immediate utilization, the container, or fireplace is constructed or used to prevent the escape of sparks, embers, and other combustion materials, and such fires are constantly monitored and attended by at least one person of at least 18 years of age until the fire is extinguished.
(b) 
No such outdoor burning shall be allowed for any material of any kind or nature, including, but not limited to, garbage, trash, junk, refuse, rubbish, weeds, limbs or brush, oils, asphalts, plastics, explosives, natural or synthetic rubber, chemicals, any other materials that produce heavy smoke or that could release toxic gases or materials, or materials that are otherwise prohibited by applicable law.
(c) 
Outdoor burning conducted under subsection (a) above shall not contain electrical insulation, treated lumber, plastics, construction or demolition materials not made of wood, heavy oils, asphaltic materials, potentially explosive materials, chemical wastes, furniture, interior finishes, carpet, vehicles, appliances, items containing natural or synthetic rubber, or other natural or manmade materials that may pose a danger to life, health, or safety, or otherwise in violation of applicable law.
(d) 
No outdoor burning will be allowed at any time when the appropriate governmental authority, including, but not limited to, the county commissioners court, the village, or Travis County Emergency Service District No. 6 (including without limitation Lake Travis Fire Rescue "LTFR"), declare outdoor burning to be banned.
(e) 
A law enforcement officer of the state, the county, or the village, or a firefighter with the appropriate fire department, including, but not limited to, Travis County Emergency Service District No. 6/LTFR, is hereby authorized and may order the immediate extinguishment of any fire in the village conducted by any person within the city limits that is in violation of this article or that otherwise would create a nuisance or add to a hazardous or objectionable situation, or would otherwise cause an uncontrolled fire.

(a) 
Unless specifically provided for herein, an offense under this article or any ordinance amended hereby shall not require a culpable mental state. It is the intent of this article to impose strict liability for a violation of this article, and a specific culpable mental state is not required.
(b) 
Any individual or entity in violation of any provision of this article shall be punished by a fine not to exceed $500.00 for each violation, and each day such a violation occurs shall be counted as a separate offense.
(c) 
Any duly authorized law enforcement officer of the state, the county, or the village, a city employee in the discharge of his/her official duties, or the fire chief of Travis County Emergency Service District No. 6, or designated representative, may issue a citation or notice of violation for any violation of this article, which shall be prosecuted by the municipal court of the village.
