City parks shall be closed during summer hours from 9:00 p.m.
until 5:00 a.m. and during winter hours from 6:00 p.m. until 5:00
a.m. Winter hours shall be in effect from October 1st through March
31st of each year, and summer hours from April 1st through September
30th of each year. Except as otherwise provided in this chapter, no
person shall be or remain in any City park during the time when it
is closed.

Except as otherwise provided in this chapter, no person shall
possess or use any alcoholic beverage in a City park.

A.
Persons
wishing to utilize facilities in a City park for a special event,
lasting no longer than one day, including either the gazebo, picnic
areas or other similar areas, may reserve such areas not more than
one month in advance by submitting an application to the City Clerk
and paying such reservation fee as may be established by the Council.
Provided, however, that an entire park may not be reserved without
the consent of the City Manager or designee.
B.
No person
shall utilize or be in a City park facility or area during a time
when it has been reserved for use by another person except with the
consent of the person who has reserved the facility or area.

A.
Authority. Notwithstanding any provision of this chapter to the contrary, the City Manager may grant permits for the after-hours use of parks for special events, and for the use of alcohol within parks for special events. Requests for such permits shall be filed no less than three business days prior to the permit date requested and shall include: the name and address of the applicant, the time and date of the event, and a brief description of the nature of the event, including attendance estimates. The permit may be subject to reasonable conditions, including those relating to the provision of insurance and noise restrictions. The City Manager has the authority to allow such use permits to include a reasonable exemption (not to exceed one additional hour) from Section 9.01.030 of this title, pertaining to the effective hours of City noise regulations.
B.
Standards
for Issuance. The City Manager shall issue a permit under this section
when he or she finds:
1.
That
the proposed activity or use of the park will not unreasonably interfere
with or detract from the general public's enjoyment of the park;
2.
That
the proposed activity or use will not unreasonably interfere with
or detract from the promotion of public health, welfare, safety, and
recreation;
4.
That
the proposed activity or use will not entail unusual, extraordinary,
or burdensome expense or security operation by the City or other applicable
public agency;
5.
That
the proposed activity or use will occur on a Friday, Saturday, or
the Sunday immediately preceding a nationally recognized holiday;
and
6.
That
the facilities desired have not been reserved for another use.

In any City park in which signs notifying the public of the
provisions of this chapter have been posted, it is unlawful and a
misdemeanor to violate any provision of this chapter.
