means any offer, by five or more vendors, to sell to the
public goods, wares or merchandise which are mass produced and which
are traditional collector's items. Without limiting the generality
of the above, a show may include any of the following: coin show,
baseball card show, stamp show, and other shows similarly dedicated
to collectible cultural objects other than antiques, vehicles and
works of art. Articles abovementioned, when offered for sale in the
following settings, shall be deemed to be shows: exhibition, display,
exhibit, fair or exposition.
means any offer to sell to the public goods, wares or merchandise
with the implied or express representation that such goods are individually
crafted rather than mass produced. Such goods, wares or merchandise
may be made by one or more persons, from one or several components;
provided, that the final item is finished or enhanced in such a way
as to impart its characteristic hand-crafted nature. Such finishing
or enhancing of the final item may not, for the purposes of this chapter,
occur in a manufacturing setting which employs six or more persons
on a full or part-time basis. Without limiting the generality of the
above, a show may include any of the following: craft show, bazaar,
art show, antique show and hobby show. Articles abovementioned, when
offered for sale in the following settings, shall be deemed to be
shows: exhibition, display, exhibit, fair or exposition. For purposes
of this chapter, articles more than 100 years old are assumed to be
handcrafted.
means both collectors' shows and craft shows unless otherwise
indicated.
means those organizations or individuals, which act on behalf
of the vendor(s). As defined in this section, a sponsor may be a vendor,
an association or group of vendors, or an entity with no direct connection
with the displaying individuals. A sponsor may also include those
individuals or organizations that permit such show to operate at a
given location, whether by right of ownership, contract, agreement
or default.
means the individual participant in the show who places his
or her wares, or a representation of his or her wares, on display
with the intent to sell.

No vendor shall sell or offer to sell any individually crafted
or collector's goods, wares or merchandise without first obtaining
the proper license necessary for compliance with the provisions of
this or any other chapter of the Imperial Beach Municipal Code.

Application for the license required by Section 4.10.020 shall be filed with the Administrative Services Director by the sponsor on behalf of the vendor(s). It is the intent of this chapter to license special event vendors through the sponsors of such shows. Any sponsoring individual or organization shall be licensed under the ordinary business license provisions of Title 4 of this code. This section and/or any other portion notwithstanding, sponsors claiming exemption under Section 4.04.030 of this code shall make application under the provisions of Chapter 4.04.

Upon filing by the sponsor, there shall be issued by the Administrative Services Director a coupon or series of coupons that shall be deemed to be the license(s) for such show. The fee for the issuance of such license(s) shall be set by resolution. The sponsor will issue a license coupon to each vendor, except that any vendor qualifying for exemption under Section 4.04.030 of this code will not be liable for the license fee.
Each vendor license shall contain the following information:

name of the sponsor;
B.
The
location at which the show is to be held;
C.
Name
and signature of the individual vendor, certifying under penalty of
perjury the correctness of the information;
D.
Date
the show is to be held;
E.
Type
of goods offered for sale;

A.
The vendor shall not be relieved from the payment of any license tax for the privilege of doing such business required under any other ordinance of the City, and shall remain subject to the regulatory provisions of other ordinances. The term of the license shall be as defined in Section 4.04.230. License fees are due for each day during which the show is open to the public.
B.
Vendors:
(1) holding a valid business license; (2) having a fixed location
of the business within the City limits; (3) who display their regular
business license during the special event show, shall not be required
to obtain a special event license.
C.
Sidewalk vendors as defined in Chapter 4.64 of this code: (1) holding a valid business license; (2) holding a valid sidewalk vendor permit; (3) who display their regular business license and sidewalk vending permit during the special event show, shall not be required to obtain a special event license.

Within 10 days of the closing of each show, the sponsor shall
return to the Administrative Services Director copies of the licenses
that were issued to each vendor, and any unissued coupons for which
a refund is requested.
