The provisions of this chapter shall apply to all swimming pools, wading pools, fish ponds and other uncovered bodies of water, except the Pacific Ocean, located within the R-1, R-2 or R-3 districts in the city, as shown on the district map which is a part of the zoning code, which are eighteen inches or more in depth.

The bodies of water as defined and limited in Section 8.24.010 shall not be located closer than four feet from any rear or side property line, nor closer to the front property line than the required building setbacks as established by the zoning code.

Every person having land on which is located a body of water as defined by Section 8.24.010 of this chapter shall enclose said body of water within a fence at least four feet high. Said four feet shall be measured vertically from the top of said fence to the finish grade adjoining the fence outside of the yard area within the enclosure. Said fence shall be of a solid wall or chain link type and shall have gates at least four feet high with a self-latching mechanism. Such gates shall be kept closed when not in use, and latches shall be installed at least four feet above ground level.

An alternative protective device in lieu of the fence required in Section 8.24.030 will be permitted when said alternative device has the prior approval of the building and safety department of this city. Said building and safety department shall only approve an alternative device which, in its judgment, is equivalent to the fencing described in Section 8.24.030 and effectively provides the protection intended by this chapter.

The drainage of any of the bodies of water defined in Section 8.24.010 into any street, sidewalk or alley in this city is prohibited. Drainage of any of said bodies of water into a sewer opening with a diameter greater than three inches is prohibited.
