Note: Editor's Note: The Laguna Canyon Annexation Area Specific Plan is on file at City Hall. The M-1B light industrial zone of the plan was amended in its entirety by Section 3 of Ordinance No. 1433, passed December 2, 2003.
The intent and purpose of this chapter is to establish a specific plan for the Laguna Canyon Annexation area pursuant to the authority of Article Chapter 3 of Division 7 of the California Government Code. It is recognized that there is a need for a comprehensive planning program to address the unique issues associated with the Laguna Canyon Annexation area and that this need is best served through the establishment of a specific plan. The Laguna Canyon Annexation Area Specific Plan contains goals and polices and zoning provisions, all of which form the development regulations for the specific plan area. All other ordinances and sections of the Laguna Beach Municipal Code shall also apply to the specific plan area, unless such standards are inconsistent with the provisions of the specific plan, in which case, the provisions of the specific plan shall apply.

The specific plan covers an eight hundred and ninety acre area of Laguna Canyon and is generally framed by the curve of Laguna Canyon Road known as "Big Bend" to the south, El Toro Road to the east, Laguna Canyon Road to the north and the ridgeline of the Canyon to the south. The physical boundaries of the specific plan area are delineated on Exhibit A as shown following this chapter.

All development regulations for the Laguna Canyon Annexation Area are contained within the text of the document. These regulations include goals and policies, zoning provisions and development standards.

(A) 
Intent and Purpose. The intent and purpose of the Emergency Shelter Overlay District is to identify the area where emergency shelters are allowed by right, subject to development and operation standards and in accordance with Section 65583 of the California Government Code. The Emergency Shelter Overlay District shall consist of the property within the Institutional Zone of the Laguna Canyon Annexation Area located at 20652 Laguna Canyon Road. This area is shown in Figure A below.
(B) 
Objective Standards. This section sets forth standards for the establishment and operation of emergency shelter facilities. Emergency shelters that comply with these standards may be established without a use permit or any other discretionary review and are exempt from the provisions of the California Environmental Quality Act. However, any development within the Coastal Zone that constitutes development as defined in Section 25.07.006(D) and that is not exempt pursuant to Section 25.07.008 requires approval of a coastal development permit pursuant to Chapter 25.07.
(1) 
The emergency shelter must comply with all objective development standards prescribed by Section 25.28.030. However, if a conflict exists between the standards of Section 25.28.030 and the standards in this section, the standards of this section shall prevail.
(2) 
Maximum Number of Beds. The maximum number of beds per emergency shelter facility shall not exceed the most recent point-in-time count for unhoused individuals within Laguna Beach at the time of application submittal, not to exceed 45 beds per facility. Beds shall be made available to individuals meeting the City-defined criteria for local individuals; the emergency shelter facility shall not be a regional facility.
(3) 
Parking Requirements. On-site parking shall be provided at a ratio of not less than one vehicle space per staff person working in the emergency shelter during peak hours. Parking lot and access improvements shall be designed to meet City standards. Enclosed, secure bicycle parking shall also be provided on-site at a ratio of not less than one bicycle space per 10 beds.
(4) 
On-Site Waiting and Intake Areas. On-site waiting and client intake areas shall be provided in the emergency shelter building. Outdoor waiting areas, if provided, shall be visually screened from the public right-of-way and from adjacent land uses.
(5) 
On-Site Management. The emergency shelter shall provide at least one qualified on-site manager during all hours of operation and at least one hour prior to and after shelter operating hours.
(6) 
Maximum Stay. The maximum length of stay by an individual in an emergency shelter shall not exceed six months in any consecutive 12-month period. No individual shall be denied emergency shelter because of an inability to pay.
(7) 
Lighting. Site and building lighting shall be provided for safety and security in a manner consistent with Chapter 7.70 of the Municipal Code.
(8) 
Personal Storage. A private storage area, such as a closet or a locker may be provided with each on-site bed. Regulations regarding personal storage use shall be set by City-approved policy, posted onsite, and provided upon intake to all clients.
(9) 
Shower and Toilet Facilities. Toilets, sinks, and showers shall be provided on-site. The emergency shelter manager shall be responsible for ensuring that all restroom and shower facilities comply with the City's Building Code requirements.
(C) 
Prior to the issuance of a Certificate of Occupancy or commencement of the emergency shelter use, the emergency shelter operator shall submit the following plans to the Director of Community Development. The plans shall be solely for informational purposes; said plans shall not be subject to discretionary review and/or approval.
(1) 
Security Plan. A plan for security during hours that the emergency shelter is in operation. Such security plan may include fencing, appropriate surveillance measures, and/or on-site security personnel.
(2) 
Operations Plan. A plan for operation of the facility containing the following information.
a. 
Client intake and screening processes;
b. 
A description of services to be provided at the emergency shelter;
c. 
Length of stay allowed for clients;
d. 
Hours of operation;
e. 
A set of facility rules and procedures for maintaining a safe environment within and outside the emergency shelter;
f. 
The posting of signage regarding rules of the emergency shelter;
g. 
Secure storage areas for personal possessions;
h. 
Staff training programs;
i. 
Referral services and distribution of resources available to clients for obtaining permanent shelter, mental and physical health care, career development, and educational, legal, and other supportive services;
j. 
The manner in which the cleaning of client's clothing will be accommodated. On-site laundry facilities for clients are encouraged;
k. 
The following services may be provided for the exclusive use or benefit of the shelter residents. If any are provided, the operation plan shall include a description of those services:
i. 
Childcare services, and evidence that any required state license has been secured;
ii. 
Substance abuse counseling and evidence that any required state license has been secured;
iii. 
Standards, rules, and operational arrangements covering on-site meal preparation and/or other means of providing food; and
iv. 
The manner in which clients' pets will be accommodated.
(3) 
Emergency Plan. An emergency plan including but not limited to emergency contact numbers, evacuation plans, and on-site safety measures.
