A. 
A public works department is established.
B. 
The functions of the public works department shall include:
1. 
Construct, inspect, operate and maintain the city's public works facilities and city installations such as are not assigned to another department;
2. 
Enforce through the appropriate officials and divisions the laws and regulations relating to work done in public streets and ways, the construction, alteration, occupation and demolition of buildings, and land use;
3. 
Maintain in efficient operable condition automotive and other equipment of the city not otherwise assigned to another department for maintenance or for which the maintenance has not been contracted out;
4. 
Perform or direct all phases of engineering work required in connection with the functions of the city not otherwise assigned to another department;
5. 
Perform such other duties as may be assigned by the city manager and city council.

There shall be a director of public works appointed by the city manager with the consent of the city council. The director of public works, shall be responsible for the direction and control of all functions assigned to the department.
The director of public works shall have the following powers and duties:
A. 
Have charge of the department of public works of the city under the supervision of the city manager;
B. 
Have control and supervision over all the public works of the city, including, but not limited to, streets and street improvements, water system, sanitary and storm drain sewer systems and sewer plans, sanitary landfill sites and operations, maintenance and service yards and buildings, public buildings and facilities, and the maintenance of parks, grounds and appurtenant facilities;
C. 
Coordinate with and assist the employees responsible for planning and development, engineering, and in the planning and development of city facilities, parks, and public works;
D. 
Submit an annual budget to the city manager for his or her approval, rejection or amendment;
E. 
Such other functions and duties as the city manager may, from time to time, specify.

The duties of the director of public works may be performed by the holder of any other paid office in the city at the discretion of the mayor and the council, and, in such event, such official shall, by virtue of the assignment of these duties, become ex officio director of public works.
