The areas of special flood hazard are those areas identified by the Federal Emergency Management Agency in the Flood Insurance Study Report entitled "Orange County, California and Incorporated Areas," dated February 18, 2004, with an accompanying Flood Insurance Rate Map, dated February 18, 2004 (and any succeeding revised maps), including all amendments and revisions, all of which are hereby adopted and incorporated by reference herein. The revised Flood Insurance Study Report, together with the Flood Insurance Rate Map, is on file in the office of the city engineer, Buena Park City Hall, 6650 Beach Boulevard, Buena Park, California.
B. 
This Flood Insurance Study is the minimum area of applicability of this division and may be supplemented by studies for other areas which allow implementation of this division and which are recommended to the city council by the city engineer.

No structure or land shall hereafter be constructed, located, extended, converted or altered without full compliance with the terms of this division and other applicable regulations. Violations of the provisions of this division by failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with conditions) shall constitute a misdemeanor. Nothing herein shall prevent the city council from taking such lawful action as is necessary to prevent or remedy any violation.

This division is not intended to repeal, abrogate, or impair any existing easements, covenants or deed restrictions. However, where this division and another ordinance, easement, covenant or deed restriction conflict or overlap, whichever imposes the more stringent restrictions shall prevail.

The degree of flood protection required by this Division II is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur on rare occasions. Flood heights may be increased by manmade or natural causes. The regulations contained herein do not imply that land outside the areas of special flood hazards or uses permitted within such areas will be free from flooding or flood damages. Adoption of and/or amendments to this division does not and shall not create liability on the part of the city of Buena Park, any elected official, officer or employee thereof, the state of California, or the Federal Insurance Administration or Federal Emergency Management Agency, for any flood damages that result from reliance on the regulations contained in this division, as it may be amended from time to time, or any administrative decision lawfully made thereunder.
