There is created the fire department, the head of which shall be the fire chief who shall be appointed by the city manager subject to approval of the city council and in accordance with the city's rules and ordinances as they may pertain.

The fire chief shall have knowledge and be qualified by training in administering all phases of fire prevention and suppression. He or she shall be familiar with the laws and regulations pertaining to fire prevention and suppression or obtain advice from those who are qualified in rendering decisions pertaining such laws and regulations. He or she shall be trained in emergency medical services and disaster preparedness.

The fire chief shall have all authority vested by law and as directed by the city council and city manager. All fire personnel shall be subject to the orders of the fire chief and all firefighters shall be subject to call by the fire chief at any time during the day or night.

The fire chief, the fire chief's deputies and the fire chief's assistants shall, during the existence of fires within the city, have all powers of law enforcement officers and any person disobeying any of the lawful orders of the fire chief or of the chief's deputies and assistants, shall be deemed guilty of a misdemeanor.

The fire chief shall be the technical advisor to the city council and all city departments on subjects related to fire protection and prevention. The fire chief shall coordinate between all departments in duties related to fire protection, prevention and suppression.

The fire chief shall develop, support and deliver programs to educate, protect, prevent and eliminate the dangerous conditions that threaten our community from unfriendly fire, sudden medical emergencies, natural disasters, and exposure to hazardous materials.

The fire chief shall be responsible for the administration of the California Code of Standards and Regulations, California Building Codes, California Fire Code, and Uniform Fire Code.
