The city council shall establish written procedures for the processing of civil citations and for conduct of contested hearings that shall ensure an independent, objective, fair and impartial review of contested parking violations. Such procedures shall be established in a council policy.

The city manager is hereby authorized to appoint or contract with qualified examiners or administrative hearing providers to conduct administrative hearings. The examiner shall not be employed, managed or controlled by a person whose primary duties are parking enforcement, parking citation, processing, collection or issuance and shall be separate and independent of the processing functions. A hearing officer's employment shall not be directly or indirectly linked to the amount of fines collected. Examiners shall have the requisite qualifications as stated in the Vehicle Code.

An annual review of the contractor providing these services shall be made by the city manager, which shall include a review of complaints made by motorists regarding the contractor. Procedures shall be established in the council policy for said review and the council shall be provided with a summary of the review upon completion.
