No person shall conduct or allow to be conducted on any residentially zoned parcel of land a garage or yard sale in violation of the following regulations:
(a) 
A garage or yard sale may not be held for more than two consecutive days.
(b) 
No more than four garage or yard sales may be conducted on the same residentially zoned parcel in any one calendar year.
(c) 
Garage or yard sale activity may not be conducted in the public sidewalks, parkways, streets, alleys or within the public right-of-way or on any public property, unless the public entity owning the property has given prior written consent to such garage or yard sale activity.
(d) 
Garage or yard sale activity shall be prohibited during the hours of 6:00 p.m. through 7:00 a.m.
(e) 
Garage or yard sale advertising signs shall be allowed per the Dana Point Sign Code [Sections 9.37.110 and 9.37.130(g) of the Dana Point Municipal Code]. In addition, such signs shall not be posted more than one day prior to the first date of the garage or yard sale, and shall be removed within one hour after the garage or yard sale is over.

Violation of this Chapter shall be deemed an infraction. For the first violation of this Chapter, the fine shall be $100. For the second violation of this Chapter in any 12 month period, the fine shall be $200. The fine for the third and each additional violation of this Chapter in any 12 month period shall be $500.
