It is declared that the public health, safety and general welfare require the regulation and control of wires, poles and other wire-carrying structures within certain areas of the City. The provisions of this chapter are adopted pursuant to the foregoing determination and declaration to preserve, protect and best serve the public peace, health, safety and general welfare.

All departments, officials and public employees of the City vested with the duty or authority to issue permits or licenses shall conform to the provisions of this chapter and shall issue no permit or license for uses, buildings or purposes in conflict with the provisions of this chapter and any permit or license issued in conflict with the provisions of this chapter shall be null and void.
Any wire strung or structure erected, constructed or maintained contrary to the provisions of this division shall be declared to constitute a public nuisance, and thereby unlawful, and the City Attorney shall, upon order of the City Council, immediately commence action or proceedings for the abatement, removal or enjoinment thereof, in the manner provided by law, and take such other action as necessary to cause the abatement and removal of such nuisance.

It is unlawful for any person to string or suspend above the surface of the ground any wires other than guyed wires, or to erect or construct, or cause to be erected or constructed, any pole or other structure designed to carry telephone, telegraph, electric conduit or other wires suspended above the surface of the ground at any place within 100 feet of the centerline of Montgomery Drive, a duly established public street in the City between the west bank of Santa Rosa Creek and the east line of Doyle Park Drive, a duly established public street in the City, except that nothing contained in this chapter shall be determined to prevent the erection or construction of electroliers or other standards for street lighting purposes along Montgomery Drive, or to prevent the stringing or suspension above the surface of the ground of any service wire leading into any building located on land abutting upon Montgomery Drive, from any telephone, telegraph, electric conduit or other utility installation upon the side or rear property line of such property abutting upon Montgomery Drive, or to prevent the stringing or suspension of any wire within any building located on land abutting Montgomery Drive.
