A curfew is hereby established in Upper Providence
Township. The hours of this curfew shall begin at 10:00 p.m. prevailing
local time on each day and end at 5:00 am. prevailing local time on
the day next succeeding.

A. It shall be unlawful for any person who has not reached the 18th anniversary of his or her date of birth to be in any of the following locations during the hours of curfew as set forth in §
141-1.
B. Any street, or the sidewalk abutting any street
in the Township, including private streets not dedicated to the Township
when they are commonly used and accessible to the public (examples
include shopping centers and roads owned by homeowners associations),
parking lots generally available to the public, parks, playgrounds,
and public buildings.
C. A person under the age of 18 and in any of the above-stated
locations during the hours of curfew shall not be in violation of
this chapter if any of the following apply:
(1) They are proceeding directly home from a job;
(2) They are proceeding directly home from a recognized
school or community event;
(3) They are on the street or sidewalk directly in
front of their own home;
(4) A vehicle breakdown or similar unforeseen event
has prevented them from reaching home prior to the start of curfew.
It shall be unlawful for any parent, guardian
or other person standing in loco parentis, knowingly or with reason
to know, to permit any such person to remain in or upon any public
street or way or otherwise to be in violation of this chapter.
