No person, firm or corporation owning or occupying any property within Upper Providence Township, except in areas used in an agricultural manner pursuant to the definition of agriculture within Ch.
300, Zoning, as amended, shall permit any grass or weeds or vegetation whatsoever, not edible or planted for some useful or ornamental purpose, to grow or remain upon any land 100 feet or less from any structure or from any street, alley or sidewalk used by the public so as to exceed a height of 12 inches or to throw off any unpleasant or noxious odor or to conceal any unsanitary deposit or to create or produce pollen.
Upon the failure, neglect or refusal of any owner or agent so notified to cut, destroy and/or to remove such grass, weeds or other vegetation within five days after receipt of the written notice provided for in §
124-2 above or within 10 days after the date of such notice, in the event that the same is returned to the post office because of its inability to make delivery thereof, provided that the same was properly addressed to the last known address of such owner or agent, the Township Manager is hereby authorized and empowered to pay for the cutting, destroying and/or removal of such grass, weeds or other vegetation or to order the removal by the Township. The owner of property on which work is done pursuant to this section shall be liable to the Township in a civil action or by the filing of a municipal claim for the cost thereof, together with 15% thereof for attorney's fees and administration.

Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution and in addition to any sums payable under §
124-3. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
