The parks and recreation commission shall consist of fifteen members who shall be appointed by the Board of Supervisors in the manner prescribed in §
2.48.020.

The regular members of the commission shall be appointed by
a majority vote of the Board of Supervisors on the basis that three
members are nominated by each of the supervisors, from residents residing
within their respective district.

The term of each regular member be for four years, except as
set forth in this section in order to initiate staggered terms. Of
the first fifteen appointees, three terms shall expire on February
1, 1978; four terms shall expire February 1, 1979; four terms shall
expire on February 1, 1980; and four terms shall expire on February
1, 1981. The first fifteen members shall cast lots to determine the
expiration date of their terms; however, not more than one appointee's
term from any one supervisorial district shall expire in any single
year.

A regular member of the commission may be removed by a majority
vote of the Board of Supervisors. A vacancy shall be filled in the
same manner as the original appointment. Any member appointed to fill
a vacancy shall serve for the remainder of the unexpired term.

Honorary parks and recreation commission members shall be appointed
by a majority vote of the Board of Supervisors. Such membership shall
be a nonvoting, lifetime membership and may be recommended by the
commission.

The Board of Supervisors shall appoint one of their members
by majority vote as liaison between the Board of Supervisors and the
parks and recreation commission. The term of the appointment shall
be for one year and shall expire on February 1, of each year, the
first expiration being February 1, 1978. This liaison board member
shall be a nonvoting member, and appointments shall be rotated amongst
all five Board of Supervisors.

The regular members of the parks and recreation commission shall
receive a mileage allowance when-ever they use their personal vehicles
for travel to and from a regular or special meeting of the commission.
The rate shall conform with the travel policy adopted by the Board
of Supervisors. Regular members of the commission shall also be eligible
to attend the annual meeting of the California and Pacific Southwest
Recreation and Park Conference. The number of commission members allowed
to attend this conference shall be determined by the Board of Supervisors
during review of the fiscal year budget annually. Commission members
are requested to alternate conference attendance, giving all members
an opportunity to attend the conference during their appointed term.
Reimbursement for conference expenses shall conform with such approval
policy by the Board of Supervisors.

At its first regularly scheduled meeting, the commission shall
organize by electing one of its members chairman and one vice-chairman,
who shall serve for one year. The assistant director of public works,
parks and recreation division, shall serve as secretary of the commission.

Regular meetings shall be held at least once a month, and special
meetings may be held upon the call of the chairman or any eight members
thereof.

A majority of the appointed voting members shall constitute
a quorum for the transaction of business.

The commission shall have the following powers:
A. Act
in an advisory capacity to the Board of Supervisors in all matters
pertaining to parks and recreation;
B. Consider
the fiscal year budget for parks, recreation and special recreation
during the process of its preparation and make recommendations with
respect thereto to the director of public works, county administrator
and the Board of Supervisors;
C. Advise
in the planning of parks and recreation facilities and programs for
the residents of the county, promote and stimulate public interest
in such facilities and programs, and obtain to the fullest extent
possible, the cooperation of school authorities and other public agencies
within the county whereas not to duplicate such facilities or programs;
D. Assist
each community of the county to meet their recreational needs by providing
consulting services in making studies and surveys, planning of facilities
and developing recreation programs at the local community level;
E. Recommend
to the Board of Supervisors a general policy for the use of parks
and recreation facilities along with rules and regulations for the
maintenance and operation of existing facilities;
F. Adopt
rules and regulations for its proceedings with approval of the Board
of Supervisors.

The Board of Supervisors of the county have established a fund
known as the special recreation budget. Said Board of Supervisors
shall establish the tax rate of this budget each year prior to setting
the overall county tax rate. The following regulations apply:
A. All
moneys raised by taxation, received from any other sources for park
and recreation purposes, such as gifts, legacies or bequests, shall
be deposited with the Merced County treasurer for credit to this fund.
B. Said
fund shall be allocated to each individual area based on the assessed
valuation of said area, unless a special gift, legacy, bequest or
reimbursement is made, it thus shall be credited to the area designated.
C. The
balance of this fund at the completion of each fiscal year shall be
encumbered, thus allowing individual areas to accumulate funds for
large or long range projects.
D. The
commission shall devise a formula equal to all communities for all
county areas for the division of each area's funds for fixed assets
and services and supplies, with the approval of the Board of Supervisors.
E. The
commission shall administer and recommend to the Board of Supervisors
the expenditure of all local area special recreation-fixed assets
expenditure requests. Service and supply funds shall not require Commission
approval, but such expenditures must conform with all purchasing requirements
of the County.
F. All
moneys in said fund shall be used for the purpose of a public parks
and recreation, including acquisition and development of sites for
parks, and playgrounds, recreation equipment or for the operation
and maintenance of existing public parks and playgrounds and for the
payment of salaries of persons employed for said work.
G. The
expenditure of each area's special recreation fixed assets funds shall
be considered by individual projects (not requiring local matching
funds).
H. The
Parks and Recreation Division shall maintain records of each area's
funds and process all requests for expenditure of funds from this
budget.
