Any person, corporation or association conducting a public assemblage
where special police protection in addition to, that provided by local
and state law enforcement agencies is necessary and desired may file
an application therefore with the Merced County Sheriff.

An application for special police protection shall be filed
with the Sheriff at least seven days prior to the need therefor. The
application shall set forth:
A. The
name and address of the applicant;
B. The
name and address of the person to be in charge;
C. The
time and place of the public assemblage;
D. A general description of the activity to be conducted and, if a dance, the name of the band. A dance permit fee shall be paid in accordance with Section
6.48.030 of the Merced County Code;
E. The
number of persons expected to attend.

The Sheriff may in his judgment and discretion agree to provide
as many Merced County law enforcement officers for special police
protection as are necessary to protect the public peace, safety, morals
and welfare. The Sheriff shall notify the applicant of the number
of Merced County law enforcement officers to be assigned and shall
notify the applicant of the fee therefor.

Merced County law enforcement officers who volunteer for duty
under this chapter may be assigned under this chapter for work in
addition to that performed during their regular working hours. When
necessary due to the number of law enforcement officers needed for
a particular event, staff who are on approved time-off may also be
assigned.

At least forty-eight hours before the time when special protection
is to be provided, the applicant shall pay to the County through the
Sheriff the fee for such special police protection as shall be set
by resolution of the Board of Supervisors. In addition to the fee,
applicants shall pay the cost of any County vehicles assigned as established
by resolution of the Board of Supervisors.

A. Compensation
paid by the County to Merced County law enforcement officers for special
duty services, if said services are performed outside regular working
hours, shall be in addition to the regular salary of the individual
and shall be computed at rates to be set by resolution of the Board
of Supervisors.
B. Compensation
paid by the County for special duty services as set forth in this
chapter shall be full reimbursement for services performed under this
chapter. Merced County law enforcement officers performing services
outside their regular working hours shall furnish their own transportation
for assignments, and shall not be entitled to additional reimbursement
for meals, mileage or other expenses, if any are incurred.
C. Merced
County law enforcement officers assigned to special duty during regular
working hours shall be compensated in accordance with the Merced County
Salary Ordinance.

Special duty compensation earned by Merced County law enforcement
officers under this chapter shall be certified to the Auditor-Controller
in such form and with such supporting detail as may be required by
the Auditor-Controller. Compensation so earned and certified shall
be paid on the next regular County payroll.

Personnel assigned under this chapter will act as peace officers
and will perform their duties in conformity with established Merced
County Sheriff's Department policies and procedures. They shall perform
only those duties normally performed by a peace officer.

Merced County law enforcement officers are prohibited from performing
extra police services for public or private individuals or organizations
in or out of uniform except as provided in this chapter.

This chapter shall provide the exclusive means for assigning
and compensating special duty Merced County law enforcement officers
for special police services as set forth under this chapter. The Sheriff
may assign Merced County law enforcement officers for work outside
their regular working hours under this chapter without other approval.
