No person shall operate a business consisting of watchmen, guards, or security patrols within the City without first obtaining a license from the City to do so. The security patrol license required by this section shall be in addition to and not in lieu of a business license required by Chapter
20 of the Lake Oswego Code.

A business applying for a security patrol license shall file
an application with the Chief of Police and furnish therewith such
of the following information as may be requested by the chief of police:
1. True
names, and dates of birth of all employees.
2. Military
discharge papers of all employees, where applicable.
3. Blanket
consent forms signed by all employees authorizing the release of any
and all criminal information concerning the applicant’s employees
to the City of Lake Oswego.
4. Any
other information which the police chief shall reasonably deem necessary.

Upon filing of an application, the Chief of Police shall cause the information supplied under LOC §
14.10.625 to be held on file in the police department.

Prior to the issuance of a security patrol license, the applicant
shall furnish, and at all times while the license is in force, shall
maintain a surety bond and a policy of liability insurance.
1. The
surety bond shall be in favor of the City of Lake Oswego for the benefit
of the City and any and all persons who might be damaged by the theft
or defalcation of the applicant or the applicant’s agents or
employees in the conduct of the business. The bond shall be issued
by an authorized corporate surety in an amount not less than $2,000.
In lieu of such corporate surety bond, the applicant may deposit with
the City for such purpose cash or government securities of not less
than $2,000.
2. The
policy of liability insurance shall insure the applicant against liability
for property damage up to $50,000 and liability for bodily injury
or death up to $100,000 per person and $500,000 per occurrence arising
out of the negligent act or omission of the applicant, his agents
or employees, in the conduct of the business. The City shall require
that the policy contain a provision that the insurer will notify the
City of cancellation or non-renewal of the policy prior to termination
of coverage.

Security patrol licenses issued hereunder create no vested rights,
are not transferable, and may be revoked or suspended for cause at
any time. Licenses shall be issued on a calendar year basis to expire
on December 31 of the year for which issued; provided, however, that
if the initial license is issued on or after November 1, it shall
be valid for the remainder of the current year and for the next following
calendar year.

At least thirty (30) days prior to the expiration of any security
patrol license; or upon any change in the officers, employees, principal
stockholders or partners of a corporate or partnership licensee, the
holder of such license or permit shall apply to the chief of police
for renewal thereof. The application for renewal shall contain the
same information as is required for an initial application, or a statement
of the particulars in which information furnished with an original
application has changed.

The City Council by Resolution shall establish, and may from
time to time amend, a schedule of fees for the issuance and renewal
of security patrol licenses. Such schedule shall be established on
a basis to substantially defray the direct and indirect costs to the
City in administering the provisions hereof.

Any license issued pursuant to LOC §§
14.10.615 to
14.10.675 may be revoked or suspended by the chief of police for good cause. As used herein, "good cause" shall include a finding of misrepresentation in any information furnished to the chief of police in or with an application, bankruptcy or insolvency, violation of any law or ordinance regulating the conduct of the security patrol business, violation of any law or ordinance concerning possession or use of firearms, the commission of a felony or a misdemeanor involving moral turpitude, chronic or frequent intoxication or intoxication while on duty or the cancellation or expiration of the bond or insurance policy required hereunder.

Denial, revocation or suspension of a security patrol license
may be appealed to the City Council upon written notice filed within
ten days following the action taken by the Chief of Police. The City
Council’s ruling shall be final.

Uniforms and vehicles used by a licensee shall not be the same
as or deceptively similar to those use by the Lake Oswego Police Department
or any other public law enforcement agency in the area. All uniform
and vehicle designs and identifying marks shall be approved by the
chief of police prior to use.
