Except as herein limited, "solid waste" means all useless, unwanted
or discarded materials. Solid waste includes all putrescible and non-putrescible
wastes, whether in solid or liquid form, except liquid-carried industrial
wastes, sewage, sewage sludge, sewage hauled as an incidental part
of septic tank or cesspool cleaning-service, or dirt and rock from
construction excavation. Specifically, but without limitation, solid
waste includes garbage, rubbish, ashes, paper and cardboard, cans,
bottles, containers, street refuse, swill, demolition and construction
waste, abandoned vehicles or machinery or parts thereof, discarded
appliances, manure, plant or vegetable or garden materials, and dead
animals.

It shall be unlawful for any person to collect solid waste for
compensation or valuable consideration without first securing a franchise
from the City to do so.

Franchises for the collection of solid waste shall be granted
by ordinance, subject to the approval and acceptance of the franchisee.
To the extent permitted in the franchise ordinance, rates to be charged
by the franchisee for service may be amended by resolution.

A franchise issued by the City for solid waste collection shall
be on such terms and conditions, and for such period of time, as the
City Council may prescribe. The franchise shall provide for an appropriate
fee to be paid to the City.

In order to prevent excessive competition and to assure the
maintenance of a high level of efficiency in the collection of solid
wastes and to establish the responsibility therefor, the City may
limit or expand the number of franchises to be granted, the areas
to be served by the franchisees, and the types of solid waste to be
collected (all subject to rights of existing franchisees under existing
franchise agreements.) Nothing contained in the ordinance shall be
deemed to prevent the City, directly or through subcontractors, from
engaging in the collection of solid waste without charge or, in an
emergency, for a charge.
