The purpose of this article is to regulate the use of the public access pedestrian easement within Block 137 in downtown Lake Oswego that was granted to the City of Lake Oswego as provided in the August 13, 2013, Block 137 project development agreement between the Lake Oswego Redevelopment Agency and Evergreen Group, LLC.

For the purposes of this article, the following terms shall mean:
BLOCK 137
The property in downtown Lake Oswego bordered by First and Second Streets, A Avenue, and Evergreen Road, and described as "Block 137, Extension of the Oregon Iron and Steel Company’s First Addition to Oswego, in Clackamas County, Oregon."
BLOCK 137 PUBLIC PEDESTRIAN WALKWAY
The area running east to west within Block 137, over which a public access pedestrian easement, recorded at 2015-070926 Clackamas County Official Records, has been granted to the City of Lake Oswego. The area of the Block 137 Public Pedestrian Walkway is depicted on Illustration 42-2.

The following activities are prohibited within the Block 137 Public Pedestrian Walkway:
1. 
Driving or parking any motorized vehicle, except vehicles in use for installation, maintenance or repair of the walkway or public art, and except for motorized wheelchairs, mobility scooters and other personal mobility vehicles used by people with disabilities;
2. 
Riding bicycles, scooters (except mobility scooters as allowed under subsection (1) of this section) or similar modes of transportation;
3. 
Parking bicycles or other nonmotorized vehicles, except vehicles in use for installation, maintenance or repair of the walkway or public art;
4. 
Skating, rollerblading, or skateboarding;
5. 
Disposing, dumping, or otherwise storing any materials, refuse, garbage or other waste other than in containers placed in the walkway for such purpose;
6. 
Using any firearms or weapons. Weapons include spring or air-activated weapons, or weapons that propel projectiles by use of a bow or sling, explosives, or jet or rocket propulsion. Only authorized law enforcement officers, in accordance with their official duties, may fire or discharge any firearm or weapon in the plaza;
7. 
Consuming alcoholic beverages, except as served in outdoor seating areas operated by adjacent restaurants in compliance with all applicable laws and regulations;
8. 
Smoking;
9. 
Engaging in any commercial activities except for sidewalk cafes and displays by adjacent businesses as allowed under applicable law and regulations;
10. 
Playing amplified sound except by the operators of outdoor seating areas operated by adjacent restaurants as allowed under applicable law and regulations;
11. 
Discharging fireworks, firecrackers or explosives of any kind;
12. 
Using equipment or engaging in behavior that is hazardous or a nuisance to others or property;
13. 
Operating motorized models, planes and drones;
14. 
Bringing or allowing dogs or other pets within the Block 137 Public Pedestrian Walkway unless leashed and controlled by the owner or keeper at all times. Owners or keepers must promptly remove solid waste deposited by the animal;
15. 
Entering or remaining in the Block 137 Public Pedestrian Walkway during times when posted signage states the walkway is closed to the public.

Violation of any provision of this article shall constitute a civil violation enforced under the procedures, and subject to the penalties, established in LOC Article 34.04.
