For the purposes of this article, the following terms shall mean:
BUSINESS
Any person or persons, or any entity, corporate or otherwise, engaged in commercial, professional, charitable, political, industrial, educational, or other activity that is nonresidential in nature, including public bodies.
SOURCE SEPARATE
To separate recyclable material from other solid waste.

The purpose of this Article is to comply with the business recycling requirements set forth in Metro Code Chapter 5.10. A significant increase in business recycling will assist the Metro region in achieving waste reduction goals, conserving natural resources and reducing greenhouse gas emissions.

The requirements of this Article shall apply to all businesses within the City, except any business activity that is conducted within a residence as a home occupation, as defined in LOC § 50.10.003.2.

1. 
Businesses shall:
a. 
Source separate from the waste stream all paper, cardboard, glass and plastic bottles and jars, and aluminum and tin cans for reuse or recycling;
b. 
Cause all source-separated materials that are not reused by the business to be recycled;
c. 
Provide and maintain recycling containers in all internal maintenance or work areas in sizes and quantities sufficient to allow all recyclable materials to be collected and stored; and
d. 
Post accurate signs or adhere labels where recyclable materials are collected or stored that identify the materials that the business must source separate for reuse or recycling, and that provide source separation instructions.
2. 
Persons and entities that own, manage or operate premises with business tenants, and that provide garbage collection service to those business tenants, shall provide recycling collection systems adequate to enable the business tenants to comply with the requirements of subsection (1) of this section.

The City Manager may grant a business an exemption from one or more of requirements of LOC § 60.02.050(1) if the business demonstrates to the satisfaction of the City Manager that, because of unavoidable circumstances, compliance is not physically possible.

A business that is required to have a business license pursuant to LOC Article 20.02 shall certify to the City in writing, in a form approved by the City Manager, upon application for an initial business license and with each annual application for renewal of a business license, that the business is in compliance with the requirements of LOC § 60.02.050.
2. 
Failure to submit a certification as required by subsection (1) of this section shall be grounds for denial of issuance or renewal of a business license.
3. 
A business that is not required to have a business license pursuant to LOC Article 20.02, or that is exempted from the business license requirement by state law, shall certify to the City in writing at least once each calendar year, in a form approved by the City Manager, that it is in compliance with the requirements of LOC § 60.02.050.
