Any person desiring to be billed for disposal charges shall
make application to the superintendent of sanitation on the form prescribed
by him which application shall contain the name and address of the
firm or individual desiring to be billed and the permit number of
the person desiring the billing. The application shall also contain
a provision that the signer thereof accepts and acknowledges all and
singular the terms and provisions of the charter of the city, ordinances,
resolutions and motions passed by the city and all rules and regulations
fixed and prescribed by the city now in effect or which may be hereafter
passed which concern or relate to the management, operation and protection
of the refuse collection and disposal system of the city.

Before any permittee shall have billing for disposal charges
from the city, he shall deposit with the sanitation department a deposit
in the amount of fifty dollars ($50.00). Such deposit shall bear no
interest and shall be refunded to the depositor when he shall have
discontinued the use of the billing service and shall have paid all
bills and accounts due the sanitation department or furnish the department
satisfactory evidence of his right to receive the deposit. All demands
for refunds of such deposits shall be made within two (2) years after
the date of discontinuation of billing service and deposits unclaimed
after such period shall be subject to such account service charges
as may from time to time be established by resolution or motion of
the city council, or upon council order shall become property of the
city. This deposit is required and made in the nature of a guarantee
for the payment of disposal charges and the deposit or any part thereof
may be applied by the sanitation department to the payment of any
such account when it becomes past due. This deposit shall not be made
nor accepted in the nature of prepayment but only as guarantee. Failure
to pay the disposal bill when due by the permittee is considered notice
from the permittee to discontinue service and apply so much of the
deposit as is necessary for the payment of the then past due account.
In case any deposit or any part thereof shall have been applied in
payment of past due accounts, no service may be reestablished until
the deposit shall have been brought back up to the full amount required.
Excluded from the deposit requirements are any governmental agencies
or utility companies franchised by the city.

The minimum rate for billing for disposal charges shall be twenty
dollars ($20.00) per month. Excluded from the minimum billing charge
shall be all governmental agencies or utility companies franchised
by the city.

(a) All bills for solid waste disposal charges shall be due and payable
fifteen (15) days after issuance. A penalty of five (5) percent shall
be charged to any person, firm or institution that fails to pay his
bill after fifteen (15) days from issuance. The five-percent late
payment penalty shall apply to all classes of consumers served..
(b) As used in this section, date of issuance shall mean the date when
a bill is placed in the United States mail, properly addressed to
the person, firm or institution.

(a)
An assessment is hereby levied for removing garbage, rubbish
and trash in accordance with the schedule listed in this section.
This shall be the minimum assessment and any additional charges for
extra pickups, extra service or extra containers which are now or
may in the future be assessed shall be in addition to this charge.
(1)
Residential (one unit): Eighteen dollars and fifty cents ($18.50)
per month, effective October 1, 2023, plus any applicable state or
federal fee or surcharge.
(2)
Small commercial, churches, day nurseries, private schools,
professional offices, home beauty shops, other customary home occupations,
nursing homes, orphan, maternity and geriatric homes, lodges, sororities
and fraternities generating less than twenty (20) cubic feet per pickup
and sharing with at least 3 other business or residential units: Thirty-six
dollars and forty-eight cents ($36.48) per month effective October
1, 2023, plus any applicable state or federal fee or surcharge.

Multifamily (more than four units with container), mobile home
parks with container, commercial, institutional, hotels, dormitories,
motels, hospitals, clinics, governmental agencies, and industrial:

(A) Plus any applicable state or federal fee or surcharge.
(B) When two businesses share a dumpster, the monthly
charge per container size is divided equally among the two businesses.
(C) Roll-off containers shall be assessed a one hundred
and twenty dollars ($120.00) charge per pickup, three dollars ($3.00)
per day rental, and thirty-eight dollars and twenty-five cents ($38.25)
disposal fee per to plus any applicable state or federal fee or surcharges,
effective October 1, 2023.
(D) Compactor containers shall be assessed a charge
of one hundred and twenty dollars ($120.00) per pickup in addition
to thirty-eight dollars and twenty-five cents ($38.25) disposal fee
per ton plus any applicable state or federal fee or surcharges, effective
October 1, 2023.
(E) For the purpose of this section and its use herein,
the word "container" shall mean a detachable container of heavy durable
material subject to being moved by automation.
(b) There is excepted from this charge those schools, churches, hospitals,
institutions, governmental agencies or businesses which file with
the water department a copy of a contract between such resident, owner
or occupant and a licensed private garbage or trash hauler for the
removal of garbage and trash.
(c) The charge assessed herein shall be collected by the water department.
The garbage charge shall be placed on the water bill of the person
assessed such charge and shall become due and payable in the same
time and manner as the water charge. In the event the person does
not have city water service, an agreement must be executed covering
garbage service along with the payment of the first month’s
service in advance; thereafter statements shall be made and mailed
to such person and shall be payable on or before the tenth day after
the date of billing.
(d) Partial payment of water and garbage charges shall be accepted only
in cases of extreme hardship. In the event such partial payments are
accepted, the amount paid shall be prorated between the water charge
and the garbage charge.
(e) In the event the garbage charge is not paid after becoming due and
payable, notice of delinquency shall be mailed to the person owning
such account and water and garbage service shall be discontinued five
(5) days after the date of such delinquent notice if the account is
not paid. In the event the garbage charge is not paid in accordance
with any garbage service agreement after delinquent notice as stated
above, service shall be discontinued and shall not be commenced again
until payment of all due charges and the payment of one month’s
service charge in advance.

The following rates shall be applicable to all scheduled extra
pickups of detachable containers beyond the regular service of two
(2) pickups per week:
2 cubic yards or less, per pickup: $4.00.
3 cubic yards, per pickup: $6.00.
4 cubic yards, per pickup: $8.00.
6 cubic yards, per pickup: $12.00.
8 cubic yards, per pickup: $16.00.

All scheduled services for special events sponsored by civic
and nonprofit organizations shall be provided at the minimum charge
to cover actual cost of service.

All waste requiring special handling by federal, state or local
regulation, if accepted, shall be charged for on the basis of actual
costs incurred by special handling.

The manager of the city solid waste department shall be authorized
to make changes in the number of weekly container pickups and the
days and times of container pickups to fit weather, seasonal and usage
conditions as required by such circumstances. However, the pickups
shall not be less frequent than once a week between October 1 and
February 28 and not less frequent than twice a week between March
1 and September 30. The solid waste superintendent is authorized to
vary the date up to two (2) weeks depending on weather conditions.
Where fewer than three (3) households share one dumpster, the solid
waste superintendent shall have the discretion to provide once a week
pickup.
