The provisions of the Municipal Waste Planning, Recycling, and Waste Reduction Act (Act of 1988, No. 101, as amended)[1] require Colebrookdale Township to implement a mandatory recycling program and authorize the Township to require mandatory source separation and to enter into contracts for up to five years with persons responsible for the collection or transportation of municipal waste generated within the Township. Pursuant to that authority, Colebrookdale Township has enacted Ordinance No. 7-91 which will require the separation and collection of identified recyclable materials. Pursuant to that authority, Colebrookdale Township has entered into a contract for collection of designated recyclables generated by residential dwellings containing three or fewer dwelling units per structure.

Pursuant to the requirements and authority of Act 101, an annual fee in an amount as set from time to time, not more than annually, by resolution of the Board of Commissioners is hereby imposed upon the owners of all residential dwellings situate in Colebrookdale Township containing three or fewer dwelling units per structure. The fee shall be designated the "residential recycling fee" and shall be collected by the Township Treasurer. For his services collecting, accounting for, and paying over to the Township the residential recycling fee, the Township Treasurer shall be entitled to retain a commission equal to 5% of the amount of the fee collected.
A. 
An owner of a residential dwelling subject to the payment of the residential recycling fee imposed by this article shall be entitled to a discount of 2% from the amount of such tax if the taxpayer pays the whole amount of such tax within two months after the date of the tax notice.
B. 
Any owner of a residential dwelling subject to the payment of the residential recycling fee imposed by this article who shall fail to make payment of such fee for four months after the date of the notice of the fee shall be charged a penalty of 10% of the amount of such fee. Any such penalty shall be added to the fee by the Treasurer and shall be collected by the Treasurer.
C. 
Any owner of a residential dwelling subject to the payment of the residential recycling fee who is age 65 or older as of January 1 of the year for which the fee is imposed and who pays the fee within four months of the date of the notice of the fee is entitled to a discount of $2 in addition to any other discount to which such person may otherwise be entitled. In the case of joint owners of a residential dwelling, if one or more of the owners is age 65 or older as of January 1 of the year for which the fee is imposed, the joint owners will be entitled to the discount provided herein even if not all of the owners are age 65 or older.
This article and the residential recycling fee established hereby shall be effective for the year 1992 and all years thereafter.
If any section, subsection, sentence, clause, or phrase of this article is for any reason adjudged to be illegal or unconstitutional, such decision shall not affect the validity of the remaining portions of this article.
