Boyertown Area Fire and Rescue, Inc., (hereinafter "the Fire Company"), organized, existing, and serving the citizens of the Township of Colebrookdale, Berks County, Pennsylvania, is hereby designated as the officially recognized Fire Company for the Township.

A. 
The Fire Company is hereby authorized to provide such services to the Township as may be necessary for the protection of property and persons situate therein, which include, by way of example and not of limitation, the extinguishing of fires, prevention of loss of life and property from fire, automobile accidents, medical emergencies, hazardous materials incidents, and other dangerous situations.
B. 
The Fire Company may also provide nonemergency and public service functions, such as, again by way of example and not of limitation, removing water from property after storms and assisting in the removal, abatement and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
C. 
The Fire Company may also conduct and participate in such training activities and drills, either within or outside of the Township, as may be deemed necessary by the officers of the Fire Company to maintain proficiency in providing service.
D. 
The Fire Company is specifically authorized to respond to calls and provide services to municipalities outside of the Township in accordance with procedures established among the various fire companies in the area.
E. 
The Fire Company may participate in educational activities involving the public and/or private schools within the area and the public in general.
The purpose of this chapter is to recognize the Fire Companies as official fire companies of the Township, and to identify authorized activities for firefighters for workmen's compensation purposes.
Nothing in this chapter shall obligate Colebrookdale Township to assume any obligation to provide financial support to any of the Fire Companies, or to allocate additional financial support to any of the Fire Companies, except as otherwise provided by law. Each Fire Company may (in accordance with all applicable federal, state, and/or local laws, ordinances, or regulations) continue to solicit funds directly from the citizens of Colebrookdale Township who reside within the respective initial coverage area of each Fire Company.
If any sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this chapter. It is hereby declared as the intent of the Board of Commissioners that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section or part hereof not been included herein.
Ordinance No. 8-93 is hereby specifically repealed in its entirety. All other ordinances or parts of ordinances which are contrary to the provisions of this chapter are hereby repealed to the extent necessary to give this chapter full force and effect.

This chapter, as amended, shall become effective upon adoption of this Code.
