The following are declared to be a public nuisance and shall be abated by the owners thereof within the prescribed time within and after written notice has been given to the owner or the agent of such owner, by any officer of the Borough directed thereto by the Code Enforcement Officer, Borough Manager, and/or Borough Manager's designee.
A. 
Any structure which is unoccupied for a continuous period of 15 days under the following conditions:
(1) 
Having any of the windows or doors in the structure broken out and either boarded up or left open.
(2) 
Having any of the roof, weatherboarding or other outside part of the structure broken off, dilapidated or open so that access can be had to the building without the use of a key, or so that rain, snow, animals, vermin and other deleterious substances or things are not excluded from the building or any part thereof.
B. 
Any structure occupied by persons:
(1) 
When the structure is not supplied with sanitary sewer service, laundry and bath facilities, and other sanitary services which are required by the laws of the Commonwealth and Borough ordinances, and have not been inspected and approved by the Plumbing Inspector.
(2) 
When a structure is not supplied with utilities including, but not limited to, sanitary sewer service, water, electric, gas, including documentation.
(3) 
When there are not sufficient rooms and sanitary beds to provide sleeping quarters for the occupants or tenants in the building within the requirements of the Housing Code and sanitary laws of the Commonwealth and the City.
C. 
Any and all structure(s):
(1) 
Which is abandoned, dilapidated, unsafe, unsanitary or uninhabitable in the opinion of the Code Enforcement Officer, Borough Manager, and/or Borough Manager's Designee, and is left so that it may be entered without the use of a key or by unauthorized persons or trespassers.
(2) 
Which, in the opinion of the Code Enforcement Officer, Borough Manager, and/or Borough Manager's Designee, is not fit for human habitation.
(3) 
Which has had a total of three or more responses by the Police or Fire Departments cumulative within a twelve-month period.
A. 
The Code Enforcement Officer, Borough Manager, and/or Borough Manager's designee shall have the authority to close and/or condemn such property and declare it a public nuisance.
B. 
Any person who violates any of the provisions of this article, and any owner of property who permits violation by his contractor, employees or agents, shall be guilty of a violation of this article and punished as provided in Chapter 1, Article II, Enforcement; General Penalty. Each day that a violation continues beyond the date fixed for compliance shall constitute a separate offense.
C. 
Where any action or prosecution is commenced under this article, charging the owner of any property with a violation on a particular date, a maintenance of the same nuisance by the owner each day shall constitute a new and separate violation of the provisions of this article, and the owner shall be subject to fine and costs for each day he permits the nuisance to remain unabated.
After the owner is given notice, and the owner fails to pay the amount due, said amount shall constitute a debt due and owing to the Borough, and the Borough may commence a civil action to collect such the unpaid debt.
A. 
All relevant ordinances, regulations, and policies of the Borough of Charleroi, Pennsylvania, not amended shall remain in full force and effect.
B. 
Any ordinance or part of an ordinance conflicting with the provisions of this article shall be subordinate to this article to the extent of such conflict, and the language contained in the article shall control.
A. 
If any section, clause, provision or portion of this article shall be held invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this article so long as it remains legally enforceable minus the invalid portion.
B. 
The Borough reserves the right to amend this article or any portion thereof from time to time as it shall deem advisable in the best interests of the promotion of the purposes and intent of this article and the effective administration thereof.
C. 
The Borough reserves the right to amend this article, fee schedule, or any portion thereof from time to time by resolution or ordinance.
This article shall be effective immediately upon enactment or as soon thereafter as the applicable laws of the Commonwealth of Pennsylvania allow.
