Those prior ordinances of the Borough of Rockledge which relate to the above fees[1] are hereby amended as follows, to include, inter alia, new or additional fees for same, which are as follows. Henceforth, this article shall be treated as a new Chapter 271, Article I, of the Borough's codified ordinances and shall be entitled "Master List of Permit Fees." Such master list shall be considered controlling over numbers set forth in other ordinances in the event of any inconsistency. It is ordained that, in the event that Borough Council wishes to amend any fee herein at any future time, such amendment of the amount may be accomplished from time to time by resolution of Council. However, in the event of any creation of a new permit or transaction or event for which the Borough charges a fee, such new permit fee may only be created by amending this article by ordinance.
A. 
Building permits and fees.
(1) 
Residential - New construction, additions, alterations and renovations.
(a) 
Applications fee: $75 (up to $2,000).
(b) 
$2,001 to $20,000: 2% of the construction cost.
(c) 
$20,001 and above: 1.5% of the construction cost.
(d) 
Minor work (not more than $250): $35.
(e) 
Certificate of occupancy: $60.
(2) 
Commercial. New construction, additions, alterations and renovations.
(a) 
Application fee: $75 (up to $2,000).
(b) 
$2,001 to $100,000: 4% of the construction cost.
(c) 
$100,001 to $200,000: 2% of the construction cost.
(d) 
$200,001 and above: 1.5% of the construction cost.

G. 
Zoning fees (required by Zoning Hearing Board).
(1) 
Residential, including single-family and all other residential buildings: $900 application fee to cover the cost of application and one zoning hearing; subsequent hearings are $250 each, payable in advance, except there is no additional cost when such hearing is the result of prior hearing being continued by the Zoning Hearing Board due to the lack of a quorum. In the event the applicant withdraws the application prior to a first hearing, the Borough will refund any difference between the $900 paid and actual costs incurred by the Borough.
(2) 
Nonresidential: $1,100.
(3) 
Zoning classification change on the Zoning Map: $400.
(4) 
Sale of zoning codes: $20.
(5) 
Use and occupancy for zoning approval prior to issuance of building permit: $50.
(6) 
Zoning and use certification from the Zoning Officer: $50.
H. 
Subdivision and land development review fees.
(1) 
All applications submitted for a proposed subdivision shall, at the time of submission and in addition to the application fee, pay a fee to establish an escrow account, from which all costs of review of the plans by the Borough Engineer will be paid. The Borough shall bill the applicants for payment of any costs which shall exceed the aforementioned escrow account's initial balance.
(2) 
Schedule of minimum review fees:
(a) 
Where public improvements are provided, the minimum fee shall be $500.
(b) 
Where no public improvements are provided, the minimum filing fee shall be $500.
(c) 
Review of commercial/industrial office plans involving only one building or land parcel shall be $500.
I. 
Fire alarm systems for commercial, industrial, institutional and multifamily: annual and six-month, per fee: $50.
J. 
Request for building/fire inspectors' services for fire investigations or wind damage:
(1) 
Residential: $35, single-family; $50 per unit for more than one-family unit.
(2) 
Nonresidential: $75.
K. 
Street opening permit. Require four inches of crushed stone, four inches of concrete and two inches of hot blacktop sealed at the seams with hot tar. Alternative method is eight inches of BCBC, two inches of hot blacktop, sealed at the seams with hot tar. Fee is $60 per square yard for the first three square yards, $30 per square yard for each additional square yard, and must be maintained a period of one year after the completion of work.

If it should be the case that a person, firm or corporation or any servant, agent, employee, contractor or subcontractor shall fail to apply for and pay the appropriate fee, as required by this article, except for emergency repairs as herein defined, then said person, firm, corporation, contractor or subcontractor shall be liable to pay double the appropriate amount of the fee which is stated in this article. The only exception to having to pay double the amount of the fee is for emergency repairs performed as the result of some immediate unforeseen event, for which sufficient time does not allow obtaining a permit prior to the start of said emergency repairs, and where said emergency repairs are being performed to secure the premises, to prevent further damage or to protect personal property, provided that the appropriate permit is obtained within 72 hours of the occurrence of the event for which emergency repairs are required and the appropriate fee is paid to the appropriate Borough official within said 72-hour period.
To the extent that the ordinances previously enacted do not deal with the setting of fees, as amended herein, said ordinances or parts thereof which are not in conflict and do not refer to specific fee setting remain in full force and effect and are not affected by this article.
