No person shall sell, offer for sale, transfer or offer to transfer any spray paint container or indelible marker to a minor, unless said minor is accompanied by a parent or legal guardian at the time of the purchase, sale or transfer.

No minor shall, at the time of purchase of the item specified in § 312-1, knowingly furnish fraudulent evidence of majority, including but not limited to a motor vehicle operator's license, a registration certificate issued under the Federal Selective Service Act, an identification card issued to a member of the armed forces or any document issued by a federal, county or municipal agency or government.
No minor shall possess any spray paint container or indelible marker at any time.
For the purposes of this chapter, the following definitions shall apply:
Any felt-tip marker, china marker or similar device that is not water soluble, which has a flat or angled writing surface of 1/2 inch or greater.
Any person under the age of 18 years.
Any retail establishment, its agents, servants or employees.
Any aluminum or metal container which contains paint or a marking substance under pressure.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not less than $50 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this chapter continues or each section of this chapter which shall be found to have been violated shall constitute a separate offense.
