It is the policy of the city to create:
A. 
An ad hoc cable communications advisory committee to advise the city council as to the granting of any cable communications franchise; and
B. 
Cable communications area advisory commissions for each franchise area to advise the city council as to the operation, renewal and replacement of any cable communications franchise.

The city council may create an ad hoc cable communications advisory committee of such composition as it may choose, to serve at its pleasure, to advise it on such matters as it may prescribe. The city council may prescribe advice as to the following:
A. 
Whether to grant a franchise;
B. 
Whether to grant or deny an application for a franchise;
C. 
Whether to issue a request for proposals and as to the contents of a request for proposals;
D. 
The evaluation of responses to a request for proposals;
E. 
Matters related to the negotiation of franchise documents; and
F. 
Amendments to this title.

The city council may establish a commission for each franchise area in which the city council grants a cable communications franchise. The city council may act as the commission, or designate an appropriate existing advisory board, commission or committee to serve as the commission for a particular franchise area; otherwise the city council shall establish a commission as set forth in this chapter.

A. 
Five of the seven regular members of each board and commission shall be appointed and have the term of office as follows:
1. 
Each member of the city council shall appoint one regular member, subject to ratification of the city council;
2. 
Each member's term of office shall be for two years commencing on September 1st of an even-numbered year and ending on September 1st of the next even-numbered year, except that the initial appointment may be at a time other than September 1st and may be for more than two years and shall expire on September 1st of the next even-numbered year after appointment. Subsequent appointments or reappointments by members of the city council shall be made every two years, prior to September 1st of each even-numbered year.
B. 
The remaining two of the seven regular members of the commission shall be appointed by the city council for a two-year term commencing on September 1st of an even-numbered year and ending on September 1st of the next even-numbered year, except that the initial appointments may be at a time other than September 1st and may be for more than two years and shall expire on September 1st of the next even-numbered year after appointments. Subsequent appointments or reappointments shall be made by the city council every two years, prior to September 1st of each even-numbered year.
C. 
There shall be no maximum length on the number of terms that may be served by a single person.
D. 
A regular member of the commission shall hold office unless and until:
1. 
The commission member submits his or her written resignation;
2. 
The commission member is removed pursuant to Section 4.32.070;
3. 
The death of the commission member; or
4. 
On or after September 1st of an even-numbered year, the commission member's successor has been appointed and has taken the oath of office.
E. 
A vacancy on a board or commission shall be filled in the same manner as provided for the regular appointment of the particular seat on the commission. A person appointed to fill a vacancy shall serve until the next September 1st of an even-numbered year.

The following general organizational requirements shall apply to the commission:
A. 
The commission shall organize and adopt rules of procedure to govern the conduct of its meetings. Such rules shall be consistent with applicable provisions of the state and federal law and city ordinance;
B. 
At the first meeting of each calendar year, the commission shall elect, by majority vote, one of its members as chair and one as vice-chair, each to serve a one-year term;
C. 
The commission, by resolution, shall provide for the time, place and manner for holding regular and special meetings;
D. 
A majority of the members of the commission shall constitute a quorum of that commission. Unless otherwise required by law, a majority of the quorum is required to act on any item.

A. 
Each regular member of the commission appointed pursuant to Section 4.32.040(A) shall serve at the pleasure of the councilmember, and his or her successor, who appointed such regular member. Each regular member appointed pursuant to Section 4.32.040(B) shall serve at the pleasure of the city council.
B. 
A regular member of the commission appointed pursuant to Section 4.32.040 may be removed from office at any time with or without cause by the councilmember, or his or her successor, who appointed such regular member.
C. 
A regular member of a board or commission appointed pursuant to Section 4.32.040 may be removed from office at any time with or without cause by a four-fifths vote of the city council.
D. 
A regular member of a board or commission will automatically be removed from office if such member has three unexcused absences.

A copy of the minutes of each meeting of a commission shall be filed with the city clerk.

A department designated by the city council shall have the responsibility for providing coordination and liaison between any cable communications advisory commission and the city, and the director or director's designee of such department shall serve as secretary of each commission.

The duties and responsibilities of each commission shall be to make recommendations to the city council concerning the following:
A. 
The renewal of a franchise pursuant to Section 4.08.200;
B. 
Exercise of the authority pursuant to Section 4.36.010 to purchase a system;
C. 
Orders for repairs or other matters pursuant to Section 4.16.170;
D. 
The operation of any independent body established to administer community use programming as provided in Section 4.20.300;
E. 
The issuance of the final order of completion pursuant to Section 4.12.150;
F. 
Complaints and excuses for violations made pursuant to Sections 4.12.180 and 4.12.190;
G. 
The regulation of nonentertainment services pursuant to Section 4.20.050;
H. 
The production or elimination of educational and entertainment services pursuant to Section 4.20.060;
I. 
The regulation of educational and entertainment services pursuant to Section 4.20.070;
J. 
Evaluations conducted pursuant to Section 4.20.200;
K. 
Regulations pursuant to Section 4.20.210;
L. 
Any action taken by the city council as to rates pursuant to Chapter 4.24;
M. 
The assignments and transfers pursuant to Chapter 4.40; and
N. 
Any matter upon which a recommendation is sought by the city council.
