There is established in the police department of the city a
traffic enforcement division to be under the control of a supervising
officer of police appointed by and directly responsible to the chief
of police.

It shall be the duty of the traffic enforcement division, with
such aid as may be rendered by other members of the police department,
to enforce the street traffic regulations of the city and all of the
state vehicle laws applicable to street traffic in the city, to make
arrests for traffic violations, to investigate traffic accidents and
to cooperate with the other officers of the city in the administration
of the traffic laws and in developing ways and means to improve traffic
conditions, and to carry out those duties specially imposed upon the
division by this title.

The position of city traffic administrator is established. The
city traffic administrator shall be the city manager. He or she shall
exercise the powers and duties as provided in this title. He or she
shall be responsible for all traffic engineering division functions
of the city.

It shall be the general duty of the city traffic administrator
to determine the installation and proper timing and maintenance of
traffic-control devices and signals, conduct engineering analyses
of traffic accidents, devise remedial measures, conduct engineering
and traffic surveys of traffic conditions, cooperate with other city
officials in the development of ways and means to improve traffic
conditions and carry out the additional powers and duties imposed
by ordinances of the city.
B.
Whenever the city traffic administrator is required or authorized
to place or maintain official traffic-control devices or signals,
he or she may cause such devices or signals to be placed or maintained.
C.
Whenever,
by the provisions of this title, a power is granted to the city traffic
administrator or a duty imposed upon him or her, the power may be
exercised or the duty performed by a person authorized by him.

Whenever the accidents at any particular location become numerous,
the traffic enforcement division shall assist with the city traffic
administrator in conducting studies of such accidents and determining
remedial measures.

The traffic enforcement division and the traffic engineering
division shall maintain a suitable system of filing traffic accident
reports. Such reports shall be available for the use and information
of the supervising officer of the traffic enforcement division and
the city traffic administrator.

A.
The
chief of police is empowered to make and enforce temporary or experimental
regulations to cover emergencies or special conditions.
B.
The
city traffic administrator may test traffic control devices under
actual conditions of traffic.
C.
The
chief of police may authorize the temporary placing of official traffic-control
devices when required by an emergency. The chief of police shall notify
the city traffic administrator of his or her action as soon thereafter
as is practicable.

A traffic committee shall be established consisting of the chief
of police, or his or her representative, the director of public works,
or his or her representative, and the fire chief, or his or her representative.
Each department head sitting on the traffic committee may appoint
one representative per year. Thereafter, replacement of department
representatives shall be approved by the city manager. Only the department
head or department heads representative may vote on the traffic committee.

It shall be the authority of the traffic committee to oversee
the duties of the city traffic administrator and chief of police as
related to the authority granted to them by this title; to suggest
the most practicable means for coordinating the activities of all
officers and agencies of the city having authority with respect to
the administration and enforcement of traffic regulations; to initiate
and assist in the preparation and review of traffic studies; to receive
and respond to complaints regarding traffic matters; and to recommend
to the city council of the city, to the supervising officer of the
traffic enforcement division, to the city traffic administrator and
to other city officials, ways and means for improving traffic conditions
and the administration and enforcement of regulations. The traffic
committee shall review and, except where city council approval is
required, authorize the placement of certain traffic control devices,
and signs as defined in this title.

Officers of the police department and such persons as are assigned
by the chief of police are authorized to direct all traffic by voice,
hand, audible or other signal in conformance with traffic laws, except
that in the event of a fire or other emergency or to expedite traffic
or to safeguard pedestrians, officers of the police department or
members of the fire department may direct traffic as conditions may
require, notwithstanding the provisions to the contrary contained
in this title or the Vehicle Code.

A.
Any
violation of this code shall be prosecuted in accordance with the
provisions of Division 17 of the Vehicle Code this code, and other
applicable laws.
B.
The
chief of police, any police officer, any community services officer,
and any code enforcement officer of the city who has received a course
of training pursuant to Section 832 of the Penal Code of the state
of California shall be authorized to enforce the provisions of this
title in accordance with Section 836.5 of the Penal Code.

No person other than an officer of the police department, or
members of the fire department, or a person authorized by the chief
of police, or a person authorized by law shall direct or attempt to
direct traffic by voice, hand or other signal; except that a person
may operate, when and as provided in this title, any mechanical pushbutton
signal erected by order of the city traffic administrator.

No person shall interfere with or obstruct in any way any police
officer or other officer or employee of the city in his or her enforcement
of the provisions of this title. The removal, obliteration, concealment
of or tampering with any chalk mark or other distinguishing mark or
method used by any police officer or other employee or officer of
the city in connection with the enforcement of any regulation of this
title shall, if done for the purpose of evading the provisions of
this title, constitute such interference or obstruction.

No person shall perform work within the public right-of-way
of any street without first obtaining a permit from the city traffic
administrator authorizing the work. Traffic control for street construction
work shall be in accordance with the conditions of the permit and
as directed by the city traffic administrator and, as a minimum, with
the requirements of the latest edition of the California Department
of Transportation Traffic Manual.
