Any person constructing or arranging for the construction of a building or dwelling in the City shall also provide for the construction of cement curbs and gutters. In commercial districts only, sidewalks shall also be constructed. Such curbs, gutters, and sidewalks shall be constructed in accordance with City specifications.
The provisions of this section shall not apply where adequate curbs, gutters, and sidewalks already exist along all street frontages adjoining the lots on which such buildings or dwellings are to be constructed.

The City shall deny the final approval and acceptance of, or final public utility connections to, any building or dwelling until curbs, gutters, and sidewalks exist, or are constructed, or their construction is guaranteed by cash or bond deposited with the City in a sum equal to the estimated costs for such cement curbs, gutters, and sidewalks. Such costs shall be estimated by the City.

In the event of unusual hardship, any person aggrieved by the provisions of this chapter may appeal to the Council. The Council, with or without a public hearing on the matter, may accept some or all of a parcel of property from the provisions of this chapter if it finds that there are special circumstances applicable to the property which makes the application of this chapter unjust and a hardship. The Council may impose such conditions as it deems necessary.
