The title of this Chapter shall be the "Lompoc City Bingo Ordinance."

A. 
Unless the particular provision or the context otherwise requires, the definitions and provisions contained in this Section shall govern the construction, meaning and application of words and phrases used in this Chapter, and, except to the extent that a particular word or phrase is otherwise specifically defined in this Section, the definitions and provisions contained in Chapter 1.04 of this Code also govern the construction, meaning, and application of words and phrases used in this Chapter. The definition of each word or phrase shall constitute, to the extent applicable, the definition of each word or phrase which is derivative from it, or from which it is a derivative, as the case may be.
B. 
"Bingo" means a game of chance in which prizes are awarded on the basis of designated number or symbols on a card which conform to numbers or symbols selected at random.

An organization specified in Section 326.5 of the Penal Code is eligible to apply to the City for a license to conduct bingo games in the City. No person shall operate or participate in a bingo game except pursuant to such a license.

A. 
An eligible organization desiring to conduct bingo game or games shall file an application in writing therefor with the City Clerk.
B. 
Upon determination that the applicant is an eligible organization as described in Section 5.16.060, the City Clerk shall issue said license to said organization.
C. 
The application shall be in a form and contain the information required by the City Clerk. The license shall be in a form and contain the information required by the City Clerk.
D. 
The license shall be effective for a period of five years from the date of issuance. The date of issuance shall appear on the license.

A. 
Whenever it appears to the City Clerk that the licensee is conducting a bingo game in violation of any of the provisions of law or this Chapter, the City Clerk shall summarily suspend the license and order the licensee to immediately cease from conducting or operating any bingo game. During the period of suspension, said license shall be null and void and no person shall conduct or attempt to conduct a bingo game thereunder.
B. 
The licensee may request a hearing before the City Clerk to determine whether the license shall be revoked by filing a notice of appeal in accordance with the requirements of Chapter 1.32 of this Code. Failure to request such a hearing shall result in revocation of the license.
C. 
Upon such request the City Clerk shall provide a hearing pursuant to the requirements of Chapter 1.32 of this Code, at which hearing the suspended licensee may appear before the City Clerk for the purpose of presenting evidence why the license should not be revoked.
D. 
If the City Clerk determines that licensee or any of its agents willfully conducted a bingo game in violation of law, the City Clerk shall sustain the suspension and revoke the license; otherwise, the City Clerk shall remove the suspension and reinstate the license. Upon revocation of such license it shall be null and void and no person shall conduct or attempt to conduct a bingo game thereunder.
E. 
The licensee shall have the right to appeal the decision of the City Clerk to the City Council by filing a notice of appeal in accordance with the requirements of Chapter 1.32 of this Code.

A. 
Prize Limitation. The total amount of prizes awarded during the conduct of any bingo game shall not exceed $500.00 in cash or kind, or both, for each separate game which is held.
B. 
Separate Accounting. All profits derived from a bingo game shall be kept in a special fund or account and shall not be co-mingled with any other fund or account. The licensee shall keep full and accurate record of its income and expenses received and disbursed in connection with its operation, conduct, promotion, supervision and any other phase of bingo games which are authorized by this Chapter. The City, by and through its authorized offices shall have the right to examine and audit each such record at any reasonable time and licensee shall fully cooperate with the City by making such record available.
C. 
Limited Interest. No individual, corporation, partnership or other legal entity except the licensee shall hold a financial interest in the conduct of any bingo game.
D. 
A bingo game shall be operated and staffed only by members of the licensee organization. Such members shall not receive a profit, wage or salary from any bingo game. Only the licensee shall operate such game, or participate in the promotion, supervision or any other phase of such game.
E. 
Open to Public. All bingo games shall be open to the public, not just to the members of the licensee organization.
F. 
Occupancy Capacity. Notwithstanding that bingo games are open to the public, attendance at any bingo game shall be limited to the occupancy capacity of the room in which said game is conducted as determined by the Lompoc City Fire Department in accordance with applicable laws and regulations. Licensee shall not reserve seats or space for any person.
G. 
Games Only on Licensee's Property. A licensee shall conduct a bingo game only on property owned or leased by it, and which property is used by such organization for an office or for performance of the purposes for which the organization is organized. The license issued under this Chapter shall authorize the holder thereof to conduct bingo games only on such property, the address of which is stated in the application. In the event the described property ceases to be used as an office or as a place for performance of the purposes for which the licenses is organized, the license shall be null and void.
H. 
No person under the age of 18 years of age shall be allowed to participate in any bingo game. No person who is obviously intoxicated shall be allowed to participate in the bingo game.
I. 
No licensee shall conduct any bingo game more than six hours out of any 24-hour period. No bingo game shall be conducted before 10:00 a.m. or after 2:00 a.m. on any day.
J. 
Participants to be Present. No person shall be allowed to participate in a bingo game, unless the person is physically present at the time and place in which the bingo game in being conducted. Participants may use more than one card.
