The collection, removal, and disposal of all solid waste may be performed by the Solid Waste Division, and no other person shall engage in the business of collection, removal and disposal of solid waste unless a permit has been issued in accordance with Article 3 of this Chapter.

The City Council may make such regulations concerning the number and manner of collections and removal of solid waste, as may be necessary to carry out the provisions of this Chapter and the Director shall enforce the same. In no case shall collection service be provided less often than once a week.

A. 
Fees and charges for the collection, removal, and disposal of solid waste, and the use of the landfill, and the rules and regulations relating to such fees and charges shall be established by the Council by resolution.
B. 
The City Council finds that the periodic collection of solid waste throughout the City benefits all occupants of places and premises in the City and, therefore, all such occupants of premises and places are made liable for the solid waste collection fees prescribed by this Article.
C. 
A charge imposed by this Article shall be a civil debt owing to the City from the occupants of property within the City. Such charges shall be collected by adding the same to the water and electricity bill, and all rules and regulations governing the collection of water and electric bills shall apply in every particular way in the collection of solid waste bills.

A. 
Requirement. The City shall supply every tenant, lessee or occupant of any premises where solid waste is generated, with the appropriate number and size of automated refuse container(s) and/or commercial bins.
B. 
Roll-Off Containers. All roll-off containers used for the collection or transportation of solid waste shall be leakproof and transported in a manner that will prevent spilling, dropping, or blowing of any solid waste upon the public right-of-way during collection or transportation.
C. 
Deposit in Containers. Every responsible party shall deposit all solid waste or cause all solid waste generated on the premises to be deposited in containers or commercial bins with covers that fit tightly to keep flies and other insects out and as otherwise approved by the City Solid Waste Division.
D. 
Collection Placement. On collections days, prior to collection time, the automated container(s) shall be placed so as to be accessible from the traveled right-of-way. Such containers shall not be placed within the limits of any street or alley so as to obstruct pedestrian or vehicular traffic or otherwise constitute a nuisance.
E. 
Permanent Placement. 300-gallon containers or larger or commercial bins shall be located in a City-approved trash enclosure without gates. If enclosures are not in place, then the containers and/or commercial bins shall be placed at a mutually agreed location; provided, however, the final decision for permanent placement shall rest with the Director.
F. 
Time of Placing. Individual containers placed for collection shall not be so placed sooner than 6:00 p.m. of the day preceding the collection and shall be removed by 6:00 p.m. of the day of collection, unless their permanent location is the collection location. Containers shall be in place for collection by 7:00 a.m. on the designated collection day. The location of the receptacles between collections shall not be on the sidewalk or curb, or in the gutter of any street or in the front yard of any residence.
G. 
Disputes Over Placement. In all cases of disputes or complaints arising from or concerning the place where solid waste containers are placed, while awaiting the removal of the contents, the Director shall designate the place, and that decision shall be final.
H. 
Clean and Sanitary Condition. With the exception of larger containers maintained by the City (300-gallon and larger), all automated refuse containers shall be kept in a clean and sanitary condition by the owner or person using the container. All containers shall have the lid closed except when solid waste is being deposited therein or removed therefrom, and shall at all times be maintained so as to be inaccessible by flies and other insects to the contents thereof.

It shall be unlawful for any person to use any cart or vehicle for the conveyance of solid waste, including but not limited to garbage, waste matter, or manure, filth, offal of any kind or any offensive or ill-smelling matter, unless the cart or vehicle is staunch, tight and closely covered with a wooden or metal cover so as wholly to prevent leakage or smell; or, to use any cart or vehicle for the conveyance or removal or manure unless the cart or vehicle is provided with a canvas cover securely fastened over the top thereof, and so constructed as to prevent the deposit of such manure or portion thereof, in or upon the streets through which such cart or vehicle may be drive. No solid waste enterprise shall receive a permit unless the equipment of such solid waste enterprise shall comply with all regulations of the City Council concerning the same. The cart or vehicle used by the solid waste enterprise shall be kept clean, well painted, and in good repair.
