No person shall discharge or shoot, within the City, any rifle, pistol, shotgun, air gun, pellet gun, spring gun, sling shot or any similar device used for the purpose of throwing, projecting or propelling instruments of any kind whatsoever. Violation of this Section shall be a misdemeanor.

No person shall have in his or her possession, within the City, any loaded rifle, pistol, shotgun, air gun, pellet gun, spring gun, sling shot or any similar device used for the purpose of throwing, projecting or propelling instruments of any kind whatsoever. The term "loaded" as used in this Section shall encompass and cover any situation whereby the instrument to be projected or discharged is inserted within or is in any way touching any of the weapons mentioned in this Section or any connected appurtenant part of such weapon.

The terms and restrictions of Sections 9.08.010 and 9.08.020 shall not apply to:
A. 
Any duly appointed peace officer while carrying out his or her official duties;
B. 
Any guards of common carriers, banks, and other financial institutions while actually employed in the transportation of any money or other thing of value; and
C. 
Any person while target shooting within a shooting gallery regularly licensed by the City.
