This chapter is enacted to regulate the parking and/or storing of large vehicles and non-motorized vehicles on City streets.

For the purposes of this chapter, the following definitions will apply:
"City street"
means any street within the City limits of Union City.
"Large vehicle"
means any vehicle exceeding the following dimensions: six feet in height and twenty feet in length; or, eight and one half feet in width.
"Non-motorized vehicle"
means a vehicle that does not meet the definition of a "motor vehicle" as defined by California Vehicle Code Section 415, meaning a vehicle that is not self propelled.
All other words or phrases that are not defined here but that appear in the California Vehicle Code shall be defined according to their definitions in the California Vehicle Code.

A. 
Large Vehicles.
1. 
No large vehicle shall be parked or left standing upon any City street between the hours of two a.m. and six a.m.
2. 
The Chief of Police, or his or her designee, may exempt an individual large vehicle parked on the right-of-way fronting the address at which the large vehicle is registered from the provisions of subsection (A)(1) to permit the loading, unloading, and servicing of the large vehicle incidental to a trip on which the large vehicle will be used. The period of the exemption shall not exceed twenty-four hours immediately preceding or after the trip.

Authorized emergency vehicles as defined by California Vehicle Code Section 165 are exempt from the provisions of subsection (A)(1).
4. 
The Chief of Police, or his or her designee, may exempt an individual large vehicle from the provisions of subsection (A) (1) of this section as to a particular location upon a showing by the person in possession and control of such vehicle of a reasonable need therefor. Such exemption shall expire at a specified time within seventy-two hours, except that the Chief of Police, or his or her designee, may extend such exemption for additional periods of seventy-two hours each, to a maximum exemption period of fifteen days, upon a showing by the person in possession and control of such vehicle that because of unusual circumstances, enforcement of said provision as to such vehicle would cause undue hardship to such a person. No more than two such exemptions shall be granted for a particular vehicle during any three hundred sixty-five day period. Not more than two such exemptions shall be granted at a particular location, or substantially similar location, during any three hundred sixty-five day period.
5. 
The Chief of Police shall grant a variance from the provisions of subsection (A)(1) of this section if, from the information presented in an application for such variance, the following facts are established:
a. 
The owner of the vehicle desires to park the vehicle in question in a residence district as defined in California Vehicle Code Section 515; and
b. 
The vehicle in question would otherwise be subject to the provisions of subsection (A)(1) of this section; and
c. 
Such vehicle is the sole vehicle registered to persons residing at the premises in question and is customarily parked at such premises; and
d. 
Such vehicle is unable to be parked off-street in compliance with the provisions of subsection (B) of this section.
Provided, however, that under no circumstances shall a variance or an exemption be granted from the provisions of subsection (A)(1) if the curb-to-curb paved portion of the street upon which the vehicle would be parked under the variance is thirty feet or less in width.
A variance granted pursuant to these provisions shall remain valid only so long as the necessary facts established in order to obtain the variance continue to exist.
B. 
Non-Motorized Vehicles.
1. 
Except as provided herein, no non-motorized vehicle shall be parked or left standing upon any street between the hours of two a.m. and six a.m.
2. 
Non-motorized vehicles owned, operated, or controlled by the City shall be exempted from the prohibition of this section, so long as such non-motorized vehicles are parked or left standing for purposes reasonably related to official City business.
3. 
Notwithstanding anything to the contrary in this section, a fifth-wheel travel trailer as defined in California Vehicle Code Section 324, a trailer coach as defined in California Vehicle Code Section 635, or any other trailer or vehicle designed for recreational purposes to carry persons or property on its own structure and so constructed as to be drawn by a motor vehicle, may be granted an exemption by the Chief of Police to park overnight under the same terms and conditions applicable to motor vehicles as set forth in subsection (A)(2) of this section.

In a residence district as defined in California Vehicle Code Section 515:
A. 
No large vehicle or non-motorized vehicle shall be parked or left standing in any part of a front yard which is not a driveway or approved extension.
B. 
No large vehicle or non-motorized vehicle shall be used as an accessory structure and at no time may the parked or stored large vehicle or non-motorized vehicle be occupied or used for living, sleeping, or housekeeping purposes.
C. 
No large vehicle or non-motorized vehicle shall be used for storage of goods, material, or equipment other than those items required for its intended purpose.

No large vehicle or non-motorized vehicle shall be parked or left standing upon any City street if any portion of such vehicle, when so parked or left standing, extends beyond eight and one-half feet from the face of a curb or overhangs or blocks the right-of-way. Authorized emergency vehicles as defined by California Vehicle Code Section 165 are exempt from this provision.
