In enacting this chapter, it is the city council's intent to allow the city to collect and preserve signatures on documents quickly, securely and efficiently. The purpose of this chapter is to utilize digital and electronic signatures, in the manner permitted by statutes and regulations applicable to municipal agencies, to conduct city business and governmental affairs, including the execution of digital contracts and other legal instruments through the use of digital and electronic signatures.

"City"
means the city of Glendale.
"Digital signature"
has the same meaning as in Section 16.5 of the California Government Code or any successor legislation.
"Electronic record"
has the same meaning in Section 1633.2 of the California Civil Code or any successor legislation.
"Electronic signature"
has the same meaning as in Section 1633.2 of the California Civil Code or any successor legislation.
"UETA"
means the Uniform Electronic Transactions Act, commencing at Section 1633.1 of the California Civil Code or any successor legislation.

A. 
In any transaction or communication with the city for which the parties have agreed to conduct the transaction or communication by electronic means, the following provisions shall apply:
1. 
When a record is required to be in writing, an electronic record satisfies that requirement if it is in accordance with the UETA or any successor legislation.
2. 
When a signature is required, the parties may agree that either:
a. 
An electronic signature satisfies that requirement, if it is in accordance with the UETA or any successor legislation; or
b. 
A digital signature satisfies that requirement, if it is in accordance with Section 16.5 of the California Government Code or any successor legislation.
B. 
This section is intended to enable the city to use digital signatures, electronic signatures, and electronic records to the fullest extent allowed by law and does not limit the city's ability to use digital signatures, electronic signatures, or electronic records in any way.
C. 
The city manager shall determine the documents for which the city will accept digital and/or electronic signatures, and acceptable technologies and vendors to provide the means for employing digital and electronic signatures under this chapter, consistent with industry best practices and statutory and regulatory requirements, to ensure the security and integrity of the signature.
