A. 
The following days shall be holidays for the purpose of this code: the first day of January; the third Monday in January; the third Monday in February; the last Monday in May; the fourth day of July; the first Monday in September; the eleventh day of November; the twenty-fifth day of December; the day designated by the President of the United States as Thanksgiving Day; the Friday following the day designated by the President of the United States as Thanksgiving Day and any day or part of a day which may be designated by the council as a holiday.
B. 
In addition to the foregoing, two days out of each calendar year are designated as a floating holiday. Floating holidays shall be approved at such time as is mutually agreeable to the employee and the employee's division head. In the event of failure for any reason to exercise such privilege during such calendar year, or prior to their termination of employment with the city, the employee shall not be entitled to compensation for said floating holiday. An employee must be employed sixty calendar days in a calendar year and must be evaluated as meeting standards of performance before becoming eligible for floating holidays. Employees who terminate their employment with the city must utilize any floating holidays prior to their last day of employment with the city.
C. 
If any of such holidays shall fall on a Sunday, the Monday next following shall be deemed to be a holiday. If any such holiday shall fall on a Saturday, the Friday immediately preceding shall be deemed to be a holiday.
D. 
The provisions of this section shall apply only to full-time employees not covered by a memorandum of understanding, in which case, the provisions of any such memorandum of understanding shall apply and prevail.

A. 
A special day of observance, day of mourning, or a like day of participation, when so declared by council by resolution, shall have the same legal effect as a holiday, and during such day or portion thereof so declared, city offices shall be closed, except those offices providing services essential to the public welfare. Unless specifically declared otherwise by the council, such day shall be between the hours of eight a.m. to five p.m.
B. 
Only employees scheduled to work on a special day of observance and not rendering essential services shall have the day off with pay. Employees whose services are declared essential by the city manager shall work during such day, or portion thereof, and shall be compensated therefor as by this section specifically provided as follows:
1. 
Fire public safety division employees who work a fifty-six-hour week and work during the hours of eight a.m. to five p.m. on such day as part of a longer day (twelve-hour day) shall receive straight time pay for nine hours of such twelve-hour day, or three-fourths of a day's pay, in addition to their regular pay as compensation. If a shorter special day of observance be declared, the extra compensation provided in this subsection shall be proportionately decreased in accordance with the number of hours so declared.
2. 
Employees in the sanitation section of the public works division shall receive straight time in addition to regular pay for each hour worked during each day or other period declared by council.
3. 
Employees on a forty-hour week required to perform essential services on such day between the hours of eight a.m. and five p.m., or such other period as may be specified in the resolution, shall receive straight time pay in addition to regular pay for each hour worked during such day or period thereof declared by the council.

When December 24th occurs on Monday, Tuesday, Wednesday or Thursday, all city offices shall remain open as per their regular daily work schedule, or until five p.m. Only employees working on this day shall be considered eligible for the following holiday:
That part of December 24th from two p.m. to five p.m. shall be and is designated a holiday; provided, however, that such holiday shall not apply to the employees in the operation of the sanitation section, fire and police divisions, whose functions are essential to the public welfare; and provided, further, that all city offices and divisions shall remain open during the hours of two p.m. to five p.m. and shall be attended by the minimum number of employees necessary as determined by the division head to perform essential services. The minimum force as designated above shall have intermissions for lunch from twelve noon to one p.m. and shall accrue compensatory time off for the hours from two p.m. to five p.m. only and which shall be taken during the hours of two p.m. to five p.m. on December 31st. Those employees receiving holiday time off shall work up to one p.m. without a lunch period on December 24th.

All full-time employees compensated on a monthly basis shall be eligible for a paid eight-hour leave of absence on all designated holidays. No employee shall receive any holiday pay if they were on a leave of absence without pay both the workday before and the workday after a holiday. Except as provided in this chapter, employees assigned to work on a designated holiday, and not given an in-lieu-of day off, shall be paid overtime at two and one-half times the employees' regular base hourly rate of pay for all hours worked on the designated holiday. Such overtime paid at two and one-half times shall be the total compensation for work on a designated holiday.

A. 
The city shall have the right to require employees to work on designated holidays. General employees required to work on designated holidays shall be allowed equivalent time off in lieu of the holiday at such time as is mutually agreeable to the employee and the employee's division head.
B. 
General employees in the police division shall be assigned a designated day off in lieu of a holiday in eleven of the twelve scheduled calendar month deployment periods by their supervisor. All scheduling shall be completed at least one calendar month prior to the next deployment period or as otherwise designated by the chief of police. Consideration shall be made to assign the affected employee an in-lieu-of day off that is in conjunction with the employee's regular assigned days off.
C. 
Nothing in this section shall prohibit any supervisor from assigning an employee a day off in lieu of a holiday on a day designated as a holiday or a day requested by the employee when the employee's supervisor determines that the employee's services on that date are not essential to the public welfare, and adequate staffing levels are maintained.

A. 
When a holiday falls on a Monday, Tuesday, Wednesday, Thursday or Friday, any employee entitled to receive a leave of absence with full pay on a holiday who is not normally required to work, shall be given a leave of absence with pay on a regular working day if the holiday is for a full day (or of a portion of a working day equal to the period of time of the holiday if such holiday is for less than one day) to be taken at such time as shall be approved by the head of his or her division.
B. 
This section shall not apply to Section 3.08.020 relating to a special day of observance, mourning or participation nor to Section 3.08.030 relating to the twenty-fourth day of December as to those employees who would not ordinarily be required to work on any of such days because of vacation, sick leave or other leave, nor shall such employees be entitled to receive compensatory pay or extra pay therefor.

In lieu of the holidays allowed by this chapter, the public safety employees of the fire and police divisions shall be compensated or allowed compensatory time off as follows:
A. 
Police Division.
1. 
Public safety employees of the police division shall be granted eleven holidays each fiscal year. Such time off shall be taken with the approval of the division head. On June 30th of each year the city shall pay such employees up to four days of unused nonmandatory holiday time at the base rate of pay in effect on such day. Any unused holiday time in excess of four days shall be forfeited. Employees shall utilize holiday time when taking off on a legally observed holiday. Employees in the tactical services, (except tactical operations bureau) and investigative services divisions, shall observe the following mandatory holidays: first day of January (New Year's Day), last Monday in May (Memorial Day), fourth day of July (Independence Day), first Monday in September (Labor Day), Thanksgiving Day, twenty-fifth day of December (Christmas Day). Court detail personnel shall observe specified Los Angeles County court holidays as their mandatory holidays.
2. 
The police division shall exercise the sole prerogative to determine staffing levels and to assign employees as necessary to maintain staffing levels and to accommodate emergency situations.
B. 
Fire Division. Public safety employees of the fire division working a fifty-six-hour work schedule shall be allowed eleven-twelfths of one day's pay per calendar month above their base salary, paid on a straight base fifty-six-hour rate, in lieu of holiday time off. For this provision, a day shall be deemed to be a period of twelve hours. Holiday-in-lieu pay is considered as overtime compensation. Employees working a forty-hour work schedule shall be covered under the existing city holiday policies and limitations as applied to other general employees.
